Director of Community Dev. /City Planner June Yotsuya, Assistant to the City Manager Shirley Conte, Executive Secretary PRESENTATIONS Rick Sanders of the Santa Fe Springs California Highway Patrol (CHP) Office and Bob Schwaab from the Automobile Club of Southern California presented to Downey Police Officer Brian Baker the 10851 California Vehicle Code Award along with a plaque and pin for his work in vehicle theft recovery. Officer Baker recovered 14 vehicles, involving three arrests. Officer Baker expressed his pleasure to be working for the Downey Police Department and introduced his wife Ricki. Mayor McCarthy introduced officers of the Downey Police Department who are recipients of Department's Distinguished Service Award: Sergeant James Orr, Corporals Daniel Murray and Gilbert Toledo, and Detectives Steven Aubuchon, Roberto Del Rio, Paul Hernandez, Edward Kelly, Mark McDaniel, Daniel Ponder and Raul Salazar. He complimented the officers for the vital role they played in a year -long narcotics trafficking case, which was the largest case of its type ever investigated by the Downey Police Department and gave a brief overview of the investigation, which involved the Federal Bureau of Investigation (FBI). Council Minutes 10/26/99 -1- 12296 Chief Caldwell introduced two additional Police Department personnel, Captain Mike Miller and Lieutenant Jim McCullough to also receive Distinguished Service Awards for their supervisorial and managerial support in this case and also introduced Steve Steinhauser, Assistant Special Agent in Charge of the Santa Ana office of the FBI, who worked closely with the City during this investigation. Mr. Steinhauser presented Certificates of Appreciation to the officers from the FBI and complimented the outstanding contribution by the Downey Police Department to this case. Sergeant James Orr stated the success of the Downey Police Department is teamwork and without Mr. Steinhauser and his team's commitment, and specifically Special Agent Will Clark, this goal would never have been accomplished. He accepted the awards on behalf of all the men and women of the Downey Police Department. HEARINGS: None CONSENT CALENDAR - ITEMS FOR REMOVAL Agenda Item VI - -4, AGREEMENT BETWEEN THE CITY OF DOWNEY AND THE DOWNEY REGIONAL MEDICAL CENTER CONCERNING CITY EMPLOYEE PHYSICALS, was removed at the request of City Manager Caton. CONSENT CALENDAR Council Member McCaughan noted he would abstain from voting on Agenda Item VI - C - 1, CASH CONTRACT NO. S.S. 489, ALLEY RECONSTRUCTION — NORTH OF SEVENTH STREET, EAST OF SMALLWOOD AVENUE, due to the close proximity to his residence. CONTRACT FOR LEGAL SERVICES WITH ALSCHULER, GROSSMAN, STEIN & KAHAN: Approve. RESOLUTION NO. 6301 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING SALARY INCREASES TO SPECIFIED EMPLOYEES (MANAGEMENT AND CONFIDENTIAL/EXEMPT) ORDINANCES ORDINANCE NO. AN ORDINANCE OF THE CITY OF DOWNEY AMENDING SECTION 3186 OF THE DOWNEY MUNICIPAL CODE RELATING TO SPEED LIMITS Mr. Alvarez advised this would be the first of several items brought before the Council to reestablish speed limits on various City streets. The California Vehicle Code requires engineering and traffic studies be conducted periodically to allow enforcement of speed limits by radar on City streets. He reviewed the criteria for establishing speed limits in residential, school vicinities, etc. and advised that other speed limits are set from the reasonable speed limit traveled by the majority of the cars (85 percent), which are arrived at through engineering surveys. Engineering studies were conducted on Florence Avenue, Washburn Road and Regentview Avenue, which confirmed that the speed limits for these street segments were consistent with the current speed limits posted. The Ordinance was read by title only. It was moved by Council Member Winningham, seconded by Council Member Lawrence, and unanimously carried to waive further reading and introduce. RESOLUTIONS: None Council Minutes 10/26/99 -3- 12298 ADMINISTRATIVE REPORTS AGREEMENT WITH ISSUES MANAGEMENT NETWORK, INC., TO PROVIDE PUBLIC AFFAIRS SERVICES FOR WATER RELATED ISSUES Ms. Yotsuya explained the cities of Downey, Artesia, Cerritos, Lakewood, Norwalk, Pico Rivera, Santa Fe Springs and Signal Hill, are currently pursuing three civil cases against the Water Replenishment District (WRD), which address three critical issues: The cities believe there is an illegal public expenditure of ublic funds; they request relief from over - assessment; and they request a determination p y re q to invalidate a proposed bond sale being conducted by the WRD. There is concern about the WRD's method of operation, including high costs to consumers, a disregard of State contracting laws, and a recent balloon in employee hiring and service contracting. WRD is also being investigated by the Fair Political Practices Commission; the State Board of Audit; and the Little Hoover Commission. Several communication consultants were interviewed, with the consulting firm of Issues Management Network, Inc. being recommended as the company that could best provide public affairs services to the coalition of cities. It was recommended that Downey serve as lead agency and enter into an agreement with Issues Management Network, Inc. for a six- month contract for $36,000, with each city responsible for a fiscal commitment of $4,500. Council. Member Lawrence felt it was important to have a spokesperson to meet with the different cities to collect their thoughts and suggestions into one focus of action. Lennie Whittington, 8542 Manatee Street, referred to the $36,000 the cities will contribute and felt it was a small amount compared to what the WRD is spending. Mayor McCarthy mentioned the frustration the Council feels in its relationship with the WRD, noting attempts to meet with them have failed. He also commended on the WRD's monthly expense for pubic s and ubic relations firms to battle the citizens for welt -head rates for the replenishment of water and that the efforts by cities has resulted in a reduction in the rates, which is not enough. It was moved by Council Member Perkins, seconded by Council Member McCaughan, and unanimously carried to approve a six - month agreement with Issues Management Network, Inc. for public affairs services for a cost not to exceed $36,000. PROPOSED DOWNEY MUNICIPAL CODE AMENDMENTS PERTAINING TO REGULATIONS FOR PUBLICATION VENDING MACHINES IN THE PUBLIC RIGHT -OF -WAY Ms. Yotsuya commented on the City's Code requirement concerning publication vending machines in the public right -of -way, noting the permit process is administered by the Public Works Department and violations are investigated by the Special Enforcement Team of the Police Department. She noted the City of Norwalk enacted changes to their code to provide more stringent standards for installation and maintenance of newsracks. Municipalities have broad powers to enact and enforce regulations to protect public health, safety and welfare, but they must often yield to rights g uaranteed under the Federal and State Constitutions. Basic First Amendment protection guarantees the freedom of press and speech and the right to distribute newspapers on public streets and in other traditional ublic areas. Ms. Yotsuya explained how courts across the country have treated this issue y p with regard to the rights of cities to regulate newsracks. In 1987, the State Legislature permitted Council Minutes 10/26/99 -4- 12299 cities to require blinder racks on newsracks that displayed harmful matter to minors. She narrated a visual program of newsracks throughout the city, including the standards adopted by the City of Norwalk. Council Member Winningham mentioned reviewing Ordinances from other cities, which are in line with Downey's, noting some cities have made changes and he would like information on the legalities of making these changes. He mentioned there are duplicate machines and machines with no posted notice stating who the owner or operator is, which is a violation of the Downey Municipal Code. He felt the fee of $10 does not cover the expenses of examining these machines, stating the City needs to examine the permit process; how often they will be inspected; and address the maintenance issues. Council Member Lawrence indicated the intent of Downey's Ordinance and those of other cities was to preserve the Constitutional rights of the people providing the information. She referred to the suggestion of limiting the number of machines and felt the City should deal with the legalities of this issue, pointing out that other cities have set priorities for who gets the racks, such as adjudicated daily papers, weekly, etc. There does not appear to be compliance with the City's current regulations. y g She requested information on whether the newsrack owners have encroachment permits and business licenses; if there is a contact person on each rack; and what is out there. Some cities have different rules for their main business district downtown, which is a congregating point, noting she is in favor of this. She suggested a sticker system that is visible at all times, with a different color for each year, and a review of the maintenance and graffiti removal issues. Council Member McCaughan complimented staff on the thoroughness of the report and felt the current Code is adequate in some areas but needs adjustment. He noted a GIS computer graphics system can track the program and he was interested in knowing what the cost would be to have a system in place to process data so the City would know what newsracks do not have decals, look suspicious, and what the cost of enforcement would be to carry out such a program, along with some of the adjustments that other cities have incorporated, so that Downey can adjust its fee accordingly. He commented on the possible liability to the City from unpermitted newsracks if somebody runs into them in the public right -of -way. The streetscape is the impression Downey lends to people who are visiting. Council Member Perkins noted he does not mind adding regulations and rules, but unless they are enforced they are useless. He mentioned some of the slides shown show that the City is not enforcing the current laws. He suggested staff look into having a yearly tag for newsracks, noting this might also offset some of the costs and it would identify where the racks are located in the City. Mayor McCarthy mentioned the restriction on the sale of alcohol within a certain radius of churches and schools and wondered if some of the same factors could be applied to newspaper racks, particularly those that are questionable or offensive. He inquired if the owner of the newsrack is required to take out a business license as well as a permit. Ms. Yotsuya replied the owners are required to take out a business license and, in applying for an encroachment permit, they are required to provide proof of insurance for liability purposes. Updating the fee would be one way to maintain enforcement and also the level of nsurance The City is responsible for the maintenance and appearance of the public areas and felt the coverage. y P inspection of the newsracks might be better suited to Code Enforcement. He asked if the City were to either her own or to maintain the units, could it control the appearance and simply charge what is legal. Ms. Yotsuya advised that she did not have much information on this option and would y research it further to see how it works in some of the larger communities. Lennie Whittington, 8542 Manatee Street, stated he did not want to see the City getting into areas that could result in a lawsuit with the American Civil Liberties Union or adult oriented companies who have a large amount of funds saved up for these purposes. He noted prior courts have P g alread y ruled against total prohibition of newspaper racks on public property. He stressed the importance of knowing what laws have been challenged successfully and what laws are still pending. P g It is his understanding that previous court cases have established that streets and sidewalks are P appropriate P presumed to be a ro p riate laces for the First Amendment and cities are limited to restrict the time, place, and manner of such uses. Council Member Winningham asked if there is a minimum limit for liability on an encroachment P ermit and was informed the general requirement is a million dollars. Council Member Winningham felt the City should review this issue, as it is now at $100,0005300,000. He noted other cities have been successful in limiting the number of racks on city blocks and he would like to take a look at this. The City needs to know where each and every machine is; incorporate some of the wording in the Ordinances of other cities; and if the machines are abandoned for 15 days, pick them up. It was moved by Council Member McCaughan, seconded by Council Member Lawrence, and unanimously carried to d irect staff to continue the process of refining the City's Municipal Code y involving publication vending machines; review Ordinances from other cities; incorporating the comments of the City Council tonight; and bringing this back to the Council in January 2000. Lennie Whittington referred to the comment about newracks that do not have anything in them for 15 P days and mentioned there are some publications that only come out weekly and others monthly and suggested the Council bear this in mind. ORAL COMMUNICATIONS: None ADMINISTRATIVE REPORTS (Cont.) CONTRACT FOR INTERIM FIRE CHIEF SERVICES Mr. Caton PP requested the Council approve an agreement to employ Ron Irwin as Interim Fire q Chief after January 3, 2000, when he retires for a period up to a maximum of 960 hours while the recruitment process for a new chief takes place. Council Minutes 10/26/99 - I 3 3 0 1 Lennie Whittington, 8542 Manatee Street, referred to the hourly rate and automobile utomobile allowance noted in the report and questioned if the amount listed covered all employee benefits, and the response was that all benefits are included. It was moved by Council Member McCaughan, seconded by Council Member Lawrence, and unanimously carried to approve the agreement for interim Fire Chief Services. LETTER FROM DOWNEY CHAMBER OF COMMERCE FOR 25 -YEAR LEASE EXTENSION John Lacey, 8419 Dacosta Street, President of the Downey Chamber of Commerce, urged the Council's support of the request to extend the lease for 25 years and reviewed the Chamber's present p lease agreement, which will expire on September 13, 2008. The Chamber would like to remodel the current structure, with plans to possibly go to two- stories. Council Member Lawrence volunteered to be a member of the two - Council Member Sub - committee. In response to the suggestion that he serve as the second member of the Subcommittee, Council Member McCaughan agreed as long as the Council allows the subcommittee to not only look at the issue of the Chamber building but also to look at the concept of a City Mall in the area in front of the Library. It was moved by Council Member Perkins, seconded by Council Member Winningham, and unanimously carried to nominate Council Members Lawrence and McCaughan to serve as the two- Council Member Subcommittee to look into a long -range planning program surrounding the Library itself. Lennie Whittington, 8542 Manatee Street, inquired as to who built the Chamber of Commerce building and was informed it was built by the Chamber. He referred to the mention of a second story and asked if staff had checked it out and if it was found to be permissible. • OTHER BUSINESS - Consent Calendar ; Item removed b Council Approval AGREEMENT BETWEEN THE CITY OF DOWNEY AND THE DOWNEY REGIONAL MEDICAL CENTER CONCERNING CITY EMPLOYEE PHYSICALS Mr. Caton distributed a revised agreement, which had been placed in the public packet. He explained the Downey Regional Medical Center modified the letter agreement, which was reviewed by the City Attorney's office with the opinion it does not negatively impact the City or the proposed agreement in any way. Assistant Chief/Fire Marshal Sauter gave a brief overview of the physical examinations to be conducted. It was moved by Council Member McCaughan, seconded by Council Member Lawrence, and unanimously carried to approve the agreement between the City of Downey and the Downey Regional Medical Center (DRMC) concerning city employee physicals. Council Minutes 10/26/99 -7- 13302 Lennie Whittington, 8542 Manatee Street, referred to the mention of different personnel performing the physicals and inquired if going through the physical therapy department assured the use of the same doctors and the response was yes. He referred to the previous Council Meeting where the Council approved another agreement with Downey Regional Medical Center, noting current lawsuits pp g against the City by DRMC and said he was not in favor of them receiving City agreements. FIFTH AMENDMENT TO CITY MANAGER'S EMPLOYMENT AGREEMENT David Bowers, 10620 Dolan Avenue, mentioned the agreement extends the City Manager's severance package from six months to twelve months, should the Council decide to terminate his employment, and felt this was excessive. Mayor McCarthy dvised that State law allows a maximum of eighteen months for salary and y Y fringe benefits to appointed government officials. Council Member McCaughan stated that cities must compete to keep their executive management intact, noting how important it is to keep someone who has shown effective leadership. g g p p It was moved by Council Member Perkins, seconded by Council Member McCaughan and unanimously carried to approve the Fifth Amendment to the City Manager's employment agreement and authorize the Mayor to execute said agreement. OTHER BUSINESS - Council Members Council Member Perkins reminded everyone to change their clocks back one hour next weekend and also, as requested by the Fire Department, to change the batteries in smoke detectors. Council Member Perkins mentioned participating in the Keep Downey Beautiful clean - up last weekend along approximately a roximately 23 5 volunteers from various community groups. He complimented Carol Rowland for this excellent program. Council Member Perkins invited everyone to attend the Special Council Meeting tomorrow night to hear the presentations of the three developers for the NASA site. Council Member McCaughan mentioned attending the Rotary Club/YMCA breakfast, which is a great community event. Council Member McCaughan noted an increasing number of abandoned shopping carts in the area of Furman Park, Seventh Street, Western Avenue and in the area around the new 99 -Cent Store. He asked staff to make sure the contractor is aware of this. Council Member McCaughan complimented the Keep Downey Beautiful display at the Library. Council Minutes 10/26/99 -8.. 13303 Council Member McCaughan referred to the minutes of the Recreation and Community Services Commission regarding the possible clubhouse renovation at the Rio Hondo Golf Course and noted he would like to have this presented before his term ends. Council Member McCaughan mentioned traveling through other communities on his way back to Downey from Pomona and complimented Downey as a fine City. '17 She noted this is frustrating for officials who have no way to respond to these communications and urged everyone to eliminate this type of correspondence. Council Member Lawrence urged everyone to vote in the November 2 " Election for the Community College Board and local Downey Unified School Board. Council Member Winningham referred to the Keep Downey Beautiful clean - up program and community pride, noting trash has begun to accumulate again in the areas cleaned up. He urged everyone to take the time to use the trash containers throughout the City at bus benches, parks, etc. Council Member Winningham encouraged everyone to attend the Annual Pumpkin Patch on Saturday night at Furman Park and acknowledged the Soroptimist and Optimist Clubs who support this event. He acknowledged the City employees who are members of these clubs. Mayor McCarthy commented on attending the Fall Convention of the Downey Soroptimist Club last weekend and expressed appreciation for their contributions to the community. Mayor McCarthy mentioned upcoming events: The Mayor's Prayer Breakfast at Rio Hondo Golf Club on Thursday; the Celebrity Waiter Luncheon on Thursday at the Embassy Suites Hotel to benefit the Leukemia Society; and the third annual Long Beach Veterans Parade, with a special ceremony to honor veterans, on Saturday, November 6th. OTHER BUSINESS - Staff Members Mr. Caton expressed his thanks to Senators Feinstein and Boxer and to Congressman Horn for their efforts in passing legislation signed by the President to give the City $4 million to help with the development of a space museum to honor those who have worked at the Rockwell- Boeing site. Mr. Caton encouraged everyone to attend the presentation tomorrow evening by the three developer finalists for the NASA site. He felt this site in many ways holds the economic future of the City. Mr. Caton mentioned he was glad to see the Coca Cola plant progressing and noted they will be participating in the Pumpkin Patch event this year by donating their product. Mr. Caton thanked staff' for giving back to the community by becoming involved in community organizations.
