HomeMy WebLinkAboutMinutes - 08-28-12 Regular Meeting MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULAR MEETING AUGUST 28, 2012 The City Council of the City of Downey held a Regular Meeting at 7:30 p.m., August 28, 2012, in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor Brossmer presiding. PRESENT: Council Members: Roger C. Brossmer Mayor David R. Gafin Mayor Pro Tem Mario A. Guerra (excused) Luis H. John Michicoff, Finance Director Gladys Chavez, Secretary The Invocation was delivered by Pastor Yader Paralles, Christian Fellowship Foursquare Church. The Flag Salute was led by Council Member Vasquez. COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND CONFERENCE /MEETING REPORTS Council Member Marquez reported attending two new Neighborhood Watch meetings at Golden Park, and congratulated the Parks & Recreation Department for a successful 2012 Twilight Summer Concert Series. Council Member Vasquez reported attending a Workforce Investment Board (WIB) meeting. Mayor Pro Tem Gafin recognized Chamber of Commerce Board of Director Jean Wood who was in the audience; congratulated Parks & Recreation for a successful 2012 Twilight Summer Concert Series; reported attending the 119 Neighborhood Watch meeting at Golden Park, and advised that Saint Raymond's Catholic Church will host Downey's Annual Blue Mass in honor of Police Officers, Firefighters, Paramedics and Military personnel on September 11 at 8:30 a.m. PRESENTATIONS Mayor Brossmer presented the California Highway Patrol (CHP) 10851 Award to Corporal Jose Gomez, Officer Peter Mendoza, and Officer Michael Greene. Mayor Brossmer presented a Certificate of Recognition to American Legion Post 270's Police Officer of the Year Honoree, Detective Javier Sanchez. City Council Regular Meeting Minutes of August 28, 2012 1 NON - AGENDA PUBLIC COMMENT The following people spoke regarding the officer - involved shooting: Terry Ramirez E.T Snell Cory Bird Jean Thaxton Timothy Bird Damien Ramirez Debra (no last name provided) Terry (no last name provided) Rebecca Guerrero, representative of the LIUNA 777 Downey City Employees Association, stated that the association acknowledges the request for change and hopes future request for re- classification of employment positions will be reviewed. Marsha Moode, Downey Civic Light Opera Director, spoke about the hardship the non - profit organization is facing in regards to the new ticket selling process of contracting through Venutech and asked to add an item on the Agenda in order to further discuss this issue. Lana Walkquist, Downey Arts Coalition, stated that the Downey Civic Light Opera is an essential and beneficial part of the community, and the City of Downey needs to return to offering discounted rates to local Downey approved non - profit organizations. John Paul Drayer, introduced himself and advised he is a candidate for the Cerritos College Trustee Area 3 Election. Mayor Brossmer requested staff provide the City Council with an outline of the recent changes in the fee structure and ticket sales for the Downey Civic Light Opera and the Downey Symphony Orchestra for further review by the City Council. CONSENT CALENDAR ITEMS REMOVED 11. ADOPT RESOLUTION NO. 12-7370, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THE CITY TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089: Community Development. This item was removed at the request of Community Development Director Saeki and set for a future Council Meeting. CITY COUNCIL CONSENT CALENDAR It was moved by Mayor Pro Tem Gafin, seconded by Council Member Marquez, with Council Member Marquez abstaining from Item No. 5 and Council Member Guerra excused, to approve the Consent Calendar. 1. APPROVED CITY COUNCIL MINUTES: Adjourned and Regular Meetings of August 14, 2012: City Clerk. 2. APPROVED THE CONTRACT BETWEEN THE CITY OF DOWNEY AND ALL CITY MANAGEMENT SERVICES, INC. FOR CROSSING GUARD SERVICES: Police Department. 8. AUTHORIZED THE MAYOR TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH THE CITY OF PICO RIVERA FOR THE TELEGRAPH ROAD RAISED MEDIAN ISLAND PROJECT BETWEEN LAKEWOOD BOULEVARD /ROSEMEAD BOULEVARD AND PASSONS BOULEVARD: Public Works. 9. ADOPT RESOLUTION NO. 12-7371, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS OF THE FINANCE DEPARTMENT: Finance. ADMINISTRATIVE REPORTS 14. STATUS OF AB 109 — PAROLEE PROGRAM: Police Department. Police Lieutenant Milligan reported on Assembly Bill (AB) 301 also known as prison realignment at the request of Council Member Marquez. Lieutenant Milligan stated that in May 2011 the United States Supreme Court mandated a reduction of prison inmates in the State of California to alleviate over crowding at its 33 prisons state wide. By November 28, 2011 the state had released 10,000 low risk offenders. On April 5, 2011 Governor Brown signed into law a public safety realignment bill known as AB 109 that displaces responsibility from the State to the local level. It encompasses several aspects of criminal sentencing, punishment, and community supervision. Low risk offenders are categorized as post release community supervision (PRCS) and are released to the county they were sentenced in. The local probation departments will provide supervision of the PRCS offender. Currently 69 PRCS's have been released in the City of Downey. The Downey Police Department is notified weekly via email from the Los Angeles County Sherriff Department that includes name and address of residence of a released parolee. The only way to keep track of a PRCS is to go to their residence. Currently 60% of City Council Regular Meeting Minutes of August 28, 2012 3 the addresses that have been provided in parolees statewide have been invalid. Most recently the Downey Police Department has assisted in two sweeps, one in East Los Angeles and one in the City of South Gate. A sweep in the City of Downey is planned for the near future. Council Member Vasquez asked: if the parolees had any gang affiliation; if the state provides any funding for supervision; and, how much money was allocated to AB 109. Lt. Milligan stated: it was possible that parolees had gang affiliation; there was no direct funding from the State to maintain the program and a dollar amount could not be placed until the Police Task Force moved forward with a sweep. Only then the Police Department can ascertain the cost involved. Council Member Marquez thanked Lt. Milligan for the information he provided and asked if there was any data available to suggest the parolees have committed crimes since their release from prison. He stated that the residents safety is always the focus even when there are unfunded State mandates. Lt. Milligan will provide data of repeat offenses by the 69 PSCR parolees in the future and stated that 40 -60% of the parolees provided incorrect addresses; therefore, the 69 parolees that gave their address as Downey may not be accurate. OTHER BUSINESS City Manager Livas stated that the arts movement is a collaboration between staff and the various organizations. He stated that the City will try to work with the Downey Civic Light Opera, but that many of the fee structures were a direct result of budget cuts.
