REGULAR MEETING
MAY 22, 2012
The City Council of the City of Downey held a Regular Meeting at 7:30 p.m., May 22, 2012, in the
Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor
Brossmer presiding.

The Invocation was delivered by Pastor Richard Holt, First Baptist Church. The Flag Salute was
led by Gabriel Hohn, Eagle Scout.
COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE /MEETING REPORTS:
Council Member Guerra reported attending the California Contract Cities Association Municipal
Seminar. He advised one of a few workshops he attended was, "The Lost Art of Compromising;"
reported not having attended the International Conference of Shopping Centers held in Las Vegas to
prevent negative perception; attended the viewing of our First Annual Solar Eclipse Event at the
Columbia Memorial Space Science and Learning Center; reported attending the live performance of
comedian Paul Rodriguez at the Downey Civic Theater; requested staff review the Lakewood
Boulevard truck size and weight limitations, and reported that November 10 -17 is National Hunger and
Homeless Awareness Week and requested staff meet to discuss coordinating resources and
participation from the community.
Council Member Marquez welcomed those in attendance; reported attending the California
Contract Cities Association Municipal Seminar workshop, "The Demise of Redevelopment."

Council Member Vasquez welcomed Warren High School students; reported attending the
California Contract Cities Association Municipal Seminar workshops, "Inside the Mind of a City
Attorney," "Inside the Mind of a City Manager," and, "The Demise of Economic Development;" reported -
attending a neighborhood watch meeting and requested staff address resident's concerns discussed
at the meeting.
Mayor Pro Tem Gafin recognized Jan Scott, President of the Downey Chamber of Commerce
who was in attendance, and advised The Downey Cemetery District Trustees will hold the Annual
Memorial Day Ceremony at the Downey Cemetery May 28
Mayor Brossmer reported attending the American Legion Downey Post -270 meeting; reported
attending the First Annual Solar Eclipses Event at the Columbia Memorial Space Science and
Learning Center; attended the California Contract Cities Association Municipal Seminar and although
he attended all of the workshops, he gained the most from having a personal conversation with a
board member from the Water Replenishing District; attended a Vector Control District meeting, and
recognized Martha Sodetani, Downey Unified School Board Member who was in attendance.
PRESENTATIONS:
Mayor Brossmer presented a Certificate of Recognition to Kelly Gendreau, 50 Assembly Woman
of Distinction Honoree from Downey for 2012.
Mayor Brossmer presented a Certificate of Appreciation to Eagle Scout Gabriel Hohn. Eagle
Scout Hohn presented Mayor Brossmer a hand crafted memorial box to hold retired American Flags.
Mayor Brossmer presented a Certificate of Recognition to Warren High School's CIF Southern
Section Division VI Champion Girls Water Polo Team; CIF Southern Section Division VI Champion
Wrestling Team; and, the Warren High School Robotics Team who competed in the 2012 VEX
Robotics World Championships in Anaheim.
Mayor Brossmer presented a Proclamation to Gina McGee, and proclaimed June 2 and 3rd,
2012 as American Cancer Society Relay for Life.
Mayor Brossmer presented a Certificate of Recognition to Mrs. Chambers, Griffith Middle School
Science Class, Room 71, for their state -of- the -art weather station.
RECESSED /RECONVENED:
Mayor Brossmer recessed the City Council Meeting at 8:14 p.m., and reconvened at 8:21 p.m.,
with all Council Members present.
PUBLIC HEARINGS:
1. ESTABLISH A FRANCHISE TOWING FEE AND APPROVE NONEXCLUSIVE FRANCHISE
AGREEMENTS FOR TOWING AND STORAGE SERVICES: Police.
A. ADOPT RESOLUTION NO. 12- , A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY AMENDING RESOLUTION NO. 11-7274, ESTABLISHING A
FRANCHISE FEE FOR THE DOWNEY POLICE DEPARTMENT TOWING SERVICE
FRANCHISE PROGRAM. ---

B. ADOPT RESOLUTION NO. 12- , A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY APPROVING A FRANCHISE AGREEMENT FOR TOWING
AND STORAGE SERVICES WITH UNITED TOWING SERVICES, INC.
C. ADOPT RESOLUTION NO. 12- , A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEYAPPROVING A FRANCHISE AGREEMENT FOR TOWING
AND STORAGE SERVICES WITH TITAN TRANSPORTATION, INC.
Mayor Brossmer opened the Public Hearing at 8:21 p.m. City Clerk Jimenez affirmed receipt of
the Proof of Publication. It was moved by Council Member Marquez, seconded by Council Member
Guerra and so ordered to receive and file. City Clerk Jimenez noted there was no correspondence
received.
Mayor Brossmer asked if the Subcommittee had a report to present to Council.
Council Member Marquez stated that due to time constraints, the Subcommittee will require more
time before being able to provide a comprehensive report to Council.
Council Member Vasquez agreed with Council Member Marquez.
Mayor Brossmer confirmed that the Subcommittee will return June 12 with a recommendation
and this item would not be continued again. The Subcommittee will either concur with the
recommendation of the Police Department or if there is a different recommendation, reasons will be
provided to Council, but, a recommendation will be made.
._. It was moved by Council Member Marquez, seconded by Council Member Vasquez, and
unanimously carried to continue the Public Hearing to June 12, 2012.
NON - AGENDA PUBLIC COMMENT:
Leonardo Zuniga spoke about a recent incident at the Columbia Memorial Space Center and
Learning Center.

Council Member Guerra stated that he believed law enforcement mistakenly spoke when using
�--- words such as "caged animal" when referring to a human being or when describing an incident.

CONSENT CALENDAR ITEMS REMOVED:
5. AUTHORIZE THE MAYOR TO EXECUTE A MEMORANDUM OF AGREEMENT WITH THE
LOS ANGELES GATEWAY REGION INTEGRATED REGIONAL WATER MANAGEMENT
JOINT POWERS AUTHORITY FOR PREPARATION OF THE COYOTE CREEK/REACH 1 OF
THE LOWER SAN GAB RI E L RIVER METALS TOTAL MAXIMUM DAILY LOAD
IMPLEMENTATION PLAN, MONITORING PROGRAM AND SPECIAL STUDIES AND

7. APPROVE LEASE AGREEMENT BETWEEN THE CITY OF DOWNEY AND DOMENICO
NAPOLI FOR 11140 DOWNEY AVENUE AND APPROPRIATE $48,000 FROM THE ART IN
PUBLIC PLACES FUND: Community Development. This item was pulled at the request of
Council Member Guerra and is listed under Other Business.
CITY COUNCIL CONSENT CALENDAR:
It was moved by Mayor Pro Tem Gafin, seconded by Council Member Vasquez, and unanimously
carried to approve the remainder of the Consent Calendar.
2. APPROVED CITY COUNCIL MINUTES: Adjourned and Regular Meetings of May 8, 2012; .----
Special Meeting of May 15, 2012: City Clerk.
3. APPROVED WARRANTS ISSUED: Warrant Nos. 267775- 268110; Wire Nos. 30002653-
30002662 and 887 -890, in the total amount of $ 3,790,164.30: Finance.
4. APPROPRIATED $23,000 FROM THE BUILDING AND SAFETY ACCOUNT AND AUTHORIZED
THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT
BETWEEN THE COPY PLACE AND THE CITY OF DOWNEY FOR THE CONVERSION OF
COMMERCIAL BUILDING PLANS TO DIGITAL COPY: Community Development.
8. LIGHTING AND LANDSCAPING DISTRICT, ASSESSMENT DISTRICT 121, FISCAL YEAR
2012/2013: Public Works.
A. ADOPTED RESOLUTION NO. 12-7331, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY APPROVING THE ENGINEER'S REPORT FOR ASSESSMENTS
WITHIN THE LIGHTING AND LANDSCAPE DISTRICT, ASSESSMENT DISTRICT 121 FOR
FISCAL YEAR 2012 -2013; and,
B. ADOPTED RESOLUTION NO. 12-7332, A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY DECLARING ITS INTENTION TO LEVY AND COLLECT LIGHTING
AND LANDSCAPING ASSESSMENTS WITHIN THE LIGHTING AND LANDSCAPE
DISTRICT, ASSESSMENT DISTRICT 121 FOR FISCAL YEAR 2012 -2013, AND SET A
PUBLIC HEARING FOR JUNE 12, 2012, TO ACCEPT PUBLIC INPUT ON THE MATTER
OF THE PROPOSED ASSESSMENT.

9. APPROVED THE USE OF THE SHOW MOBILE BY THE DOWNEY UNIFIED SCHOOL
DISTRICT FOR THE RELAY FOR LIFE COMMUNITY EVENT ON JUNE 2ND AND 3RD TO BE
+` HELD AT COLUMBUS HIGH SCHOOL: Administration.
10. APPROVED RECOGNIZED OBLIGATION PAYMENT SCHEDULE AS SUCCESSOR AGENCY
TO THE FORMER REDEVELOPMENT COMPONENT OF THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF DOWNEY FOR PERIOD JULY THROUGH DECEMBER 2012:
Community Development.
OTHER BUSINESS:
5. AUTHORIZED THE MAYOR TO EXECUTE A MEMORANDUM OF AGREEMENT WITH THE

City Manager Livas made a correction to the staff report. Remove, "appropriate $33,212 from the
General Fund" and replace with, "$3,500 from the Storm Water Fund."
It was moved by Council Member Vasquez, seconded by Council Member Guerra, and
unanimously carried to approve, as amended.
6. APPROVED OPERATING AGREEMENT BETWEEN THE CITY OF DOWNEY AND THE
---- DOWNEY ART VIBE AND APPROPRIATED $48,000 FROM THE ART IN PUBLIC PLACES
FUND: Community Development.
City Manager Livas made a correction to the staff report. Report should read, "Approve Operative
Agreement between the City of Downey and the Downey Art Vibe."
Mayor Brossmer clarified that Item No. 6 was to approve the agreement and Item No. 7 was the
allocation of funds.
Council Member Guerra clarified that this agreement was over a two year period and no General
Fund dollars will be used.
It was moved by Council Member Guerra, seconded by Council Member Vasquez, and
unanimously carried to approve, as amended.
7. APPROVED LEASE AGREEMENT BETWEEN THE CITY OF DOWNEY AND DOMENICO
NAPOLI FOR 11140 DOWNEY AVENUE AND APPROPRIATED $48,000 FROM THE ART IN

It was moved by Council Member Guerra, seconded by Council Member Vasquez, and
unanimously carried to approve as amended.

ADMINISTRATIVE REPORTS:
11. APPROVED CHANGES TO THE PROPOSED DISTRIBUTION OF COMMUNITY
DEVELOPMENT BLOCK GRANT (CDBG) PUBLIC SERVICE GRANT ADJUSTMENT FOR
PUBLIC SERVICE ACTIVITIES FOR FISCAL YEAR 2012 -2013: Community Development.
Community Development Director Saeki reported on various programs and the proposed
reduction and allocation of funds for fiscal year 2012/2013. At the request of Council, staff reduced the
budget by $1,890. Of the $1,890, $1,000 came from the Barbara J. Riley Center and $890 from the
Adult Literacy Program in order to fully fund the TLC program.
It was moved by Council Member Guerra, seconded by Council Member Vasquez, and
unanimously carried to receive and file.
STAFF MEMBER COMMENTS:
City Manager Livas congratulated the Public Works Department on the completion of the
Florence Avenue Truck Impacted Intersection Project which was completed on time and under budget.
ADJOURNMENT:
The meeting adjourned at 9:22 p.m. in memory of Chris Leuke, longtime Downey resident and
Sidonio Ramirez, father of Human Resource Director Irma Youssefieh.
