REGULAR MEETING
JUNE 12, 2012
The City Council of the City of Downey held a Regular Meeting at 7:30 p.m., June 12, 2012, in the
Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor
Brossmer presiding.

The Invocation was delivered by Associate Pastor William Martin, Love, Peace and Happiness
Church. The Flag Salute was led by Genesis Anguiano, Youth Commissioner Chair.
COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE /MEETING REPORTS:
Council Member Vasquez welcomed Emergency Preparedness Commissioner Sears who was in
attendance; congratulated Mayor Brossmer for his participation in the 2012 American Cancer Society
Relay for Life event; mentioned the Downey Art Vibe event at Porto's Bakery and Cafe; congratulated
the Public Works Department on the completion of the Florence Avenue Truck Impacted Intersection
Project, and mentioned that the Downey Kiwanis Foundation awarded over $40,000 in scholarships.
Council Member Guerra congratulated Mayor Brossmer for his participation in the 2012 American
Cancer Society Relay for Life event; reported attending the Gangs Out of Downey (G.O.O.D) meeting;
attended the 115 neighborhood watch meeting; mentioned that June 14 is Flag Day and the 236
birthday of the United States Army; reported meeting with General Raymond T. Odierno, the 38 Chief
of Staff of the United States Army; attended the Columbia Memorial Space Center and Learning Center
ribbon cutting for the national traveling exhibition program called Great Balls of Fire: Comets, Asteroids,
and Meteors; and, requested staff look into the City's Ordinance regarding advertisement signs posted
on vacant lots and foreclosed properties.

Mayor Pro Tem Gafin congratulated Mayor Brossmer for his participation in the 2012 American
Cancer Society Relay for Life event; mentioned that the Downey Chamber of Commerce will hold a
dinner in honor of Don Knabe, Humanitarian of the Year; welcomed Chairman of the Planning -
Commission Michael Murray, Emergency Preparedness Committee Member Dee Bacus, and Recreation
and Community Services Member Mark Vasquez.
Mayor Brossmer recognized Downey Unified School District Board Member Martha Sodetani and
her son Gordon, and Field Representative for Assemblyman Calderon, Mike Collin, who were in
attendance; mentioned the Downey Art Vibe event at Porto's Bakery and Cafe; reported attending the
Southern California Greek Festival; attended the 10 -year anniversary of Dn. Mario A. Guerra; mentioned
that Hometown Hardware will have a grand opening soon; attended a Southeast Water Coalition Policy
Board meeting and, reported volunteering for the Downey Meals On Wheels program.
PRESENTATIONS:
Mayor Brossmer presented a Certificate of Appreciation to the outgoing 2011 -2012 Downey Youth
Commissioners: Rebekah Jin, Gabriel Acosta, Anais Zepeda, Nick McEwen, Kimberly Matamoros, and
Genesis Anguiano.
Mayor Brossmer presented the Keep Downey Beautiful 2012 Spring Beautification Award to: Craig
Lackey, Carol Bergquist, Nelson and Ana Menendez, Rodolfo and Luz Barajas, and The Marketplace
Grill & Cafe.
PUBLIC HEARINGS:
1. LIGHTING AND LANDSCAPING DISTRICT, ASSESSMENT DISTRICT 121, FISCAL YEAR ,_,_,
2012/2013: Public Works.
A. ADOPTED RESOLUTION NO. 12 -7333, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY CONFIRMING LIGHTING AND LANDSCAPE ASSESSMENT
DISTRICT 121 FOR FISCAL YEAR 2012/2013.
Mayor Brossmer opened the Public Hearing at 7:58 p.m. City Clerk Jimenez affirmed receipt of
the Proof of Publication. It was moved by Mayor Pro Tem Gafin, seconded by Council Member Guerra
and so ordered to receive and file. City Clerk Jimenez noted there was no correspondence received.
Assistant City Manger Oskoui reported on the three part process of the annual living assessment
for landscape, street, and lighting maintenance. Initially, Council declares their intentions to levy the
assessment, City engineers prepare a report, the report is approved, and the Resolution is adopted
confirming the lighting and landscape assessment District 121 for fiscal year 2012/2013.
There being no speakers, it was moved by Mayor Pro Tem Gafin, seconded by Council Member
Guerra, and so ordered by the Mayor to close the public hearing at 7:59 p.m.
It was moved by Mayor Pro Tem Gafin, seconded by Council Member Guerra, and unanimously
carried to adopt the Resolution.
2. ESTABLISH A FRANCHISE TOWING FEE AND APPROVE NONEXCLUSIVE FRANCHISE
AGREEMENTS FOR TOWING AND STORAGE SERVICES: Police.
A. ADOPTED RESOLUTION NO. 12 -7340, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY AMENDING RESOLUTION NO. 11 -7274, ESTABLISHING A
FRANCHISE FEE FOR THE DOWNEY POLICE DEPARTMENT TOWING SERVICE
FRANCHISE PROGRAM; and,

B. ADOPTED RESOLUTION NO. 12 -7341, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEY APPROVING A FRANCHISE AGREEMENT FOR TOWING AND
STORAGE SERVICES WITH UNITED TOWING SERVICES, INC.; and,
C. ADOPTED RESOLUTION NO. 12 -7342, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF DOWNEYAPPROVING A FRANCHISE AGREEMENT FOR TOWING AND
STORAGE SERVICES WITH TITAN TRANSPORTATION, INC.
Mayor Brossmer opened the Public Hearing at 8:00 p.m. City Clerk Jimenez affirmed receipt of
the Proof of Publication. It was moved by Mayor Pro Tem Gafin, seconded by Council Member
Vasquez, and so ordered to receive and file. City Clerk Jimenez noted there was no correspondence
received.
Mayor Brossmer stated that at the May 22 Council meeting, the subcommittee stated that it would
have a recommendation for the Council. He asked what that recommendation was.
Council Member Vasquez stated that the subcommittee reviewed the proposals and researched
various tow companies. He stated some of the companies are prepared to make a presentation to
Council tonight.
Mayor Brossmer reminded Council Member Vasquez that the subcommittee was to return with a
recommendation, not with presentations.
Council Member Marquez stated that after an extensive review process of various tow companies,
the subcommittee's recommendation is to allow the tow companies to make a presentation to the
Council.
Council Member Guerra stated that it was clear that the subcommittee was to return with a
recommendation. He stated that he accepts the Police Department's recommendation.
Mayor Pro Tem Gafin stated that the subcommittee was to review all of the information and return
to Council with a recommendation not with additional material for Council to review.
Jimmy Sandu, H.P Automotive & Tow stated he submitted a proposal for towing and storage
services and is prepared to present to Council if given the opportunity.
Mr. Melendez, legal council for Jimmy Sandu, expressed his concern about the fairness of the RFP's
for tow and storage.
Dee Bacus, Chamber of Commerce, stated that the two current tow companies have served the
City well and requested Council keep the business in Downey.
Pam Chambers expressed concern about a conflict of interest with some of the subcommittee's
recommended tow companies and stated the two current tow companies have been responsive to the
City's needs.
Andrew Malarkey, stated he challenged the subcommittee's recommendations because of a
conflict of interest, and out of respect to the current tow companies.
-- There being no further speakers, it was moved by Mayor Pro Tem Gafin, seconded by Council
Member Vasquez, and so ordered by the Mayor to close the public hearing at 8:12 p.m.

Council Member Marquez stated that he wanted the process of selecting a tow company to be fair
to all interested parties and allow them to make a presentation to the City Council. He stated a few years
ago Council agreed to form subcommittees to review agreements. In line with that decision, a
subcommittee was formed for the tow agreement and their recommendation is to continue with the two
current tow companies as the Chief of Police recommended.
Council Member Vasquez stated that the subcommittee reviewed other tow companies and
determined that the two, current companies would serve the City well and mentioned that he was
impressed with Titans response time and technology and he was in favor of supporting local
businesses. The subcommittee was to provide a fair opportunity, and having accomplished that, the
subcommittee's recommendation is to support the Chief of Police's recommendation of Titan Towing
and United Towing.
It was moved by Council Member Guerra, seconded by Mayor Pro Tem Gafin, and
unanimously carried to adopt Resolution No. 12 -7341 approving a franchise agreement for towing
and storage services with United Towing Services.
It was moved by Council Member Guerra, seconded by Mayor Pro Tem Gafin and
unanimously carried to adopt Resolution No. 12 -7342, approving franchise agreement for towing
and storage services with Titan Transportation, Inc.
It was moved by Mayor Brossmer, seconded by Mayor Pro Tem Gafin and unanimously
carried to adopt Resolution No. 12 -7340, establishing a franchise fee for the Downey Police
Department towing service franchise program.

make Downey a foreclosure free City through his non profit organization, "America's Outcry of Citizens
against Mortgage Fraud."
Harold Tseklenis, thanked City Council, staff, Fire Department, and the Police Department for their
continued support of the Saint George Food Festival.

CITY COUNCIL CONSENT CALENDAR:

3. APPROVED CITY COUNCIL MINUTES: Adjourned and Regular Meetings of May 22, 2012:

4. APPROVED WARRANTS ISSUED: Warrant Nos. 268111 — 268617; Wire Nos. 30002664 —
30002682 and 890 -902, and the Cashiers Check numbers are 11 — 12, in the total amount of
$5,693,359.34: Finance.
5. APPROVED AGREEMENTS FOR THE TEMPORARY STORAGE BUILDING TO HOUSE THE
SPACE SHUTTLE MOCK -UP: Public Works.
A. APPROVED A RENTAL AGREEMENT AND A SERVICE AGREEMENT WITH ALLSITE
STRUCTURE RENTALS, LLC FOR THE INSTALLATION, RENTAL AND DISMANTLING
OF A TEMPORARY STORAGE BUILDING FOR THE SPACE SHUTTLE MOCK -UP
LOCATED AT THE DOWNEY STUDIOS; AND,
B. APPROVED A SERVICE AGREEMENT WITH DUNKEL BROS. MACHINERY MOVING,
INC., TO RELOCATE THE SPACE SHUTTLE MOCK -UP; AND,
C. APPROVED AN AMENDMENT TO THE COMMUNITY DEVELOPMENT BLOCK GRANT
RECOVERY (CDBG -R) FUND TO REALLOCATE $70,000 FOR RELOCATION OF THE
SPACE SHUTTLE MOCK -UP.
6. APPROVED AGREEMENT WITH SATSUMA FOR LANDSCAPE MAINTENANCE AT RIO
HONDO GOLF COURSE: Community Services.
7. APPROVED RENEWAL AGREEMENT WITH MV TRANSPORTATION FOR OPERATION OF
DOWNEYLINK FIXED ROUTE TRANSIT SERVICE: Community Services.
8. APPROVED RENEWAL AGREEMENT WITH MV TRANSPORTATION TO PROVIDE PART -TIME
DRIVERS FOR DIAL -A -RIDE BUSES: Community Services.
9. APPROVED PROFESSIONAL FIRE NETWORK MAINTENANCE AND SUPPORT SERVICES
AGREEMENT BETWEEN GROUP OLIVER, INC. AND THE CITY OF DOWNEY TO PROVIDE
NETWORK MAINTENANCE AND SUPPORT FOR DOWNEY FIRE DEPARTMENT AND THE
JOINT POWERS COMMUNICATIONS CENTER: Fire.
10. ADOPTED RESOLUTION NO. 12-7339, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY APPROVING A LICENSE AGREEMENT BETWEEN THE CITY OF DOWNEY AND
PCCP /IRG DOWNEY, LLC AND IRG DOWNEY LLC FOR THE PURPOSES OF TEMPORARILY
STORING THE SPACE SHUTTLE MOCK -UP: Community Development.
11. ADOPTED RESOLUTION NO. 12 -7338, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY APPROVING A SECOND AMENDMENT TO THE SPACE SHUTTLE MOCK -UP
