A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SETTING FORTH ITS FINDINGS OF FACT FOR THE SUMMARY VACATION
OF A CERTAIN PORTION OF CABELL AVENUE NORTH OF FOSTER ROAD.
THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES
RESOLVE AS FOLLOWS:
SECTION 1. Regarding the portion of the roadway at Cabell Avenue north of Foster
Road described in Exhibit "A" ( "the roadway ") the City Council finds the following from all
evidence submitted: (1) the roadway has been impassible for vehicular travel for a period of five
consecutive years, (2) that no public money has been expended for maintenance of the roadway
during that period, and (3) that there are no in -place public utilities that are in use and that would
be affected by vacation of the roadway, conditioned upon establishment of a private street and
easements for the preservation and /or relocation of utilities.
SECTION 2. The City Council further finds that the City's Planning Commission has
reported that vacation of the portion of Cabell Avenue north of Foster Road described in Exhibit
"A" is in conformity with the City's adopted General Plan, and the City Council finds that said
vacation conforms to the General Plan.
SECTION 3. The City Council hereby orders that the portion of Cabell Avenue north of
Foster Road described in Exhibit "A" shall be vacated, pursuant to the provisions of Chapter 4
(Summary Vacation) of the Public Streets, Highways, and Service Easements Vacation Law and
that from the date this resolution is recorded, the portion of Cabell Avenue north of Foster Road
described in Exhibit "A" shall no longer constitute a street.
SECTION 4. This Resolution shall take effect from and after its adoption by the City
Council.
SECTION 5. The City Clerk shall certify the passage and adoption of this Resolution
and is authorized and directed to cause a certified copy of this Resolution to be recorded in the
Office of the Los Angeles County Recorder.

Legal Description
Cabell Avenue being the Westerly 16.50 feet of the Southerly 199.00 feet of the West 5
acres of the East 10 acres of the South half of the Southwest quarter of Section 15,
Township 3 South, Range 12 West, in the Rancho Santa Gertrudes, in the City of
Downey, County of Los Angeles, State of California, as shown on map recorded in Book
1, Page 502, of Miscellaneous Records, in the office of the County Recorder of said
County. More accurately shown on map recorded in Book 443, Page 29 of maps in said
office of said County Recorder.
Except therefrom that portion of the above - described property, described as follows:
Beginning at the intersection of the Northerly line of Foster Road with the Westerly line
of the West 5 acres of the East 10 acres ofthe South half of the Southwest quarter of
Section 15, Township 3 South, Range 12 West; Thence North 89° 54' 05" East 16.50 feet
along said North line of said Foster Road to the Easterly line of the West 5 acres of the
East 10 acres of the South half of the Southwest quarter of Section 15, Township 3 South,
Range 12 West; Thence South 0° 10' 15" East 29.89 feet along last said Easterly line to
the Southerly line of the Northeast quarter of Section 15, Township 3 South, Range 12
West: Thence South 89° 43' 3 8" West 16.50 feet to said Westerly line of said West 5
acres of said East 10 acres of said South half of said Southwest quarter of said of said
