A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE MAYOR TO EXECUTE A PROFESSIONAL
SERVICES AGREEMENT TO INVESTIGATE MARKET BASED TRASH
CONTROL STRATEGIES AS THEY RELATE TO TOTAL MAXIMUM
DAILY LOAD (TMDL) BASED WATER QUALITY REGULATIONS
WHEREAS, the Federal Clean Water Act regulates water discharges from urban areas under the
National Pollutant Discharge Elimination System (NPDES) Permit program;
WHEREAS, the Los Angeles Regional Water Quality Control Board adopted an NPDES
Municipal Separate Storm Sewer System (MS4) Permit on December 13, 2001 for Los Angeles County
and 84 cities with the County, regulating the discharge of stormwater from urban areas;
WHEREAS, the Regional Board adopted the Los Angeles River Trash TMDL as Board
Resolution 01 -013, on January 25, 2001;
WHEREAS, recent settlement agreements and judicial findings indicate that the Los Angeles
River Trash TMDL was based on flawed scientific, environmental and fiscal analyses;
WHEREAS, the next Los Angeles County NPDES MS4 Permit, scheduled for adoption in
December of 2006, will incorporate existing Total Maximum Daily Loads (TMDLs) including the
retroactive implementation criteria and enforcement measures called out within them;
WHEREAS, the City of Downey in cooperation with the American Chemistry Council, County
of Los Angeles, and cities of Arcadia, Bellflower, Lakewood, Long Beach, Monrovia, Paramount, Sierra
Madre, and Signal Hill, requested grant funding or committed matching funds in support of a
demonstration grant to address Los Angeles River Trash TMDL issues;
WHEREAS, the mission of the Coalition for Environmental Protection, Restoration and
Development (CEPRD) is to facilitate a comprehensive multipurpose, stakeholder - driven consensus
process and to promote education and solutions to environmental issues by expanding working
relationships with regulatory agencies at the Federal, State, regional and local levels;
WHEREAS, CEPRD has developed a pilot project designed to establish a framework for the
utilization of market based approaches as one method for achieving mandated reductions;
WHEREAS, CEPRD has the technical knowledge and experience necessary to identify the
resources required to perform the identified professional services, and the CITY recognizes that the
CEPRD requires funding to continue this valuable work and perform the Tasks; and
WHEREAS, the City of Downey is committed to developing and implementing cost effective,
balanced, technologically and environmentally sound, water quality improvement programs that are
beneficial to our City and the greater Los Angeles County Metropolitan area;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized to execute and a Professional Services Agreement
with the Coalition for Environmental Protection, Restoration and Development (CPERD) to Investigate
Market Based Trash Control Strategies as they relate to Total Maximum Daily Load (TMDL) Based
Water Quality Regulations.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution.
