HomeMy WebLinkAboutResolution No. 6710 RESOLUTION NO. 6710 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING THE CITY MANAGER TO ISSUE A CHANGE ORDER ADDING RESTAURANT STROMWATER INSPECTIONS TO THE LOS ANGELES COUNTY ENVIRONMENTAL HEALTH SERVICES INSPECTION SERVICES AGREEMENT. —° WHEREAS, the Federal Clean Water Act regulates water discharges from urban areas under the National Pollutant Discharge Elimination System (NPDES) Permit program; WHEREAS, the Los Angeles Regional Water Quality Control Board adopted an NPDES Municipal Separate Storm Sewer System (MS4) Permit on December 13, 2001 for Los Angeles County and 84 cities with the County, regulating the discharge of stormwater from urban areas; WHEREAS, this MS4 Permit mandates that Los Angeles County cities, perform inspections of various potential pollutant sources including Construction Sites, Industrial Facilities, Retail Gas Stations, Auto Dealers, Automotive Repair Shops and Restaurants; WHEREAS, improperly operated restaurants can be significant sources of oil, grease, trash, food wastes, odors, and bacteria that may enter the local drainage and river systems; WHEREAS, there are over 250 food service facilities within the City of Downey, of which over 200 require inspection under the requirements of the current MS4 Permit and which may either individually or cumulatively be a significant source of pollution; WHEREAS, many of these initial inspections must be completed with the next year; WHEREAS, the Los Angeles County Department of Health Services, Environmental Health Division, already conducts restaurant inspections, which could simultaneously and cost - effectively include the MS4 Permit restaurant inspections requirements; WHEREAS, City, County, and Regional Water Board representatives extensively negotiated an agreement allowing County Health Inspectors to conduct these inspections at the cost of $50 per restaurant and permit cycle including up to two compliance re- visits; WHEREAS, this Change Order would allow City Staff to focus resources on the other more crucial and variable construction and industrial sources of potential water pollutants; WHEREAS, the City of Downey is committed to developing and implementing cost effective environmental programs that benefit our residents, businesses, and the environs around which we live and recreate, including the greater Los Angeles County Metropolitan area; RESOLUTION NO. 6710 PAGE TWO NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Manager is hereby authorized to execute and issue a Change Order to the existing Restaurant Inspections Agreement with the Los Angeles County Department of Public Health, Environmental Service Division. —" SECTION 2.
