HomeMy WebLinkAboutResolution No. 6708 RESOLUTION NO. 6708 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY WAIVING THE REQUIRED NUMBER OF PARKING SPACES FOR ICONS CYBER CAFE AT 8239 SECOND STREET, DOWNEY. WHEREAS, Section 9150.18 of the Downey Municipal Code allows all or a portion of the off - street parking required by Section 9150 of the Code to be waived when the lot or parcel of land involved is located within the boundaries of a Parking Assessment District, and the owner or occupant of the property pays an amount to be determined by the City Council for each automobile storage space waived; and WHEREAS, on September 23, 2003, the Downey City Council adopted Resolution No. 6701, which modified the Uniform Schedule of Fees to established a Parking Assessment District Automobile Parking fee at the semi- annual charge of one hundred dollars ($100.00) per automobile parking space in the Downtown Parking Structure; and WHEREAS, Mr. David Devis is proposing to operate the ICONS Cyber Cafe at 8239 Second Street in Downey; and WHEREAS, the subject property exists within the Downtown Parking Assessment District; and WHEREAS, the proposed computer access center use requires six (6) more off - street parking spaces than what is required per the Downey Municipal Code; and WHEREAS, Section 9150.18 of the Downey Municipal Code states that upon payment of the required sum, the City Council shall waive the specified parking spaces; and WHEREAS, on October 7, 2003, Mr. Devis paid the semi - annual fee of six hundred dollars ($600.00) to the City of Downey in lieu of waiving the residual number of off - street parking spaces. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council accept the fee to waive the six (6) parking spaces for Mr. Davis Divas, owner of the ICONS cyber cafe located at 8239 Second Street for automobile parking spaces in the Downtown Parking Assessment District in accordance to the Downey Municipal Code and the Uniform Schedule of Fees. The semi - annual parking fee will be adjusted annually within the Uniform Schedule of Fees and future payments will be reflected as such. RESOLUTION NO. 6708 PAGE TWO SECTION 2.
