A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE LAND USE ELEMENT OF THE DOWNEY GENERAL PLAN
CHANGING THE LAND USE DESIGNATION FROM "OFFICE" TO "MEDIUM
DENSITY RESIDENTIAL" FOR PROPERTY AT 8292 AND 8300 TELEGRAPH
ROAD AND ADOPT A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT (GENERAL PLAN AMENDMENT No. 03 -17)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine and
declare that:
A. On February 5, 2003, the Downey Planning Commission initiated an application
by Pacific Home Equities (hereinafter "Applicant ") for General Plan Amendment
No. 03 -17 to change the land use designation from "Office" to "Medium Density
Residential" for property at 8300 Telegraph Road (hereinafter part of "Subject
Property ") (APN 6367 - 016 -013);
B. On February 5, 2003 the Downey Planning Commission expanded the study are
for General Plan Amendment No. 03 -17 to include property at 8292 Telegraph
Road (hereinafter part of "Subject Property") (APN 6267 - 024 -022);
C. The applicant concurrently applied for a zone change to change the zoning of
8300 Telegraph Road from C2 (General Commercial) and PB (Parking Buffer) to
R3 -O (Multiple - Family Residential Ownership);
D. On May 21, 2003, the Downey Planning Commission held a duly noticed public
hearing and, after fully considering all oral and written testimony and facts and
opinions offered at the aforesaid public hearing, and adopted Resolution No. 2279
recommending the City Council approve General Plan Amendment No. 03 -17;
and
E. On June 24, 2003, the Downey City Council held a duly noticed public hearing
and, after fully considering all oral and written testimony and facts and opinions
offered at the aforesaid public hearing, and adopted Resolution No. 6677
approving General Plan Amendment No. 03 -17.

SECTION 2. Having considered all of the oral and written evidence presented to it at
said public hearings, the City Council further finds, determines and declares that:
A. Changing the land use designation from "Office" to "Medium Density
Residential" is in the public interest and in the interest of the furtherance of the
public health, safety, and welfare. The proposed "Medium Density Residential"
designation is compatible and complementary to existing conditions, since the
properties to the west are developed with multiple - family residential uses. The
new designation will minimize the impacts on the adjacent single - family
residential areas by eliminating the potential for a new commercial development
on the subject property.
B. The proposed reclassification is consistent with all other parts of the general plan
and will help the City achieve the goals of the Housing and Economic
Development Elements. The new designation will enable the construction of
additional residential units and will help the City towards meeting the housing
needs of its residents. It is consistent with Policy 2.2. of the Housing Element
which states " The City shall encourage infill development and recycling of land
to provide adequate residential sites" and Program 9.6.1.2. of the Economic
Development Element which states "phase out selected strip commercial areas."
C. No changes to other parts of the general plan are necessitated by the proposed
general plan amendment since the amendment is consistent with the goals,
policies, and programs of the general plan.
D. Changes to the zoning necessitates the proposed amendment will be implemented
within a reasonable time. The applicant has concurrently applied for a zone
change to change the zoning of 8300 Telegraph Road from C2 (General
Commercial) and PB (Parking Buffer) to R3 -O (Multiple - Family Residential).
The R3 -O zone is consistent with the "Medium Density Residential" land use
designation. A zone change would be required for 8292 Telegraph Road when
that property is ready to be redeveloped.
SECTION 3. The City Council finds, determines, and declares that General Plan
Amendment No. 03-17 will not have significant adverse effects on the environment. An initial
study of the proposed project was prepared, in accordance with the provisions of the California
Environmental Quality Act (CEQA), and indicated that there will be no significant impact on the
environmental. Accordingly, a Negative Declaration of Environmental Impact has been prepared
for General Plan Amendment No. 03-17.
SECTION 4. Based upon the findings set forth in Sections 1, 2, and 3 of this Resolution,
the City Council of the City of Downey hereby adopts the Negative Declaration of
Environmental Impact prepared for General Plan Amendment No. 03 -17.

SECTION 5. Based upon the findings set forth in Sections 1, 2 and 3 of this Resolution,
the City Council of the City of Downey hereby approves an amendment to the General Plan Land
Use Diagram, changing the land use designation from "Office" to "Medium Density Residential"
for property at 8292 and 8300 Telegraph Road.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution.
