A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE CITY'S GENERAL PLAN LAND USE DIAGRAM
CHANGING THE LAND USE DESIGNATION FOR THREE (3)
PROPERTIES LOCATED AT 8000 TELEGRAPH ROAD, 8014 TELEGRAPH
ROAD AND 8434 TWEEDY LANE FROM "OFFICE" TO "MEDIUM
DENSITY RESIDENTIAL ".
GENERAL PLAN AMENDMENT NO. 02-77
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine and
declare that:
A. On October 2, 2002, the Planning Commission initiated an application for General Plan
Amendment No. 02 -77 to re- classify three (3) properties located at 8000 Telegraph Road/
APN 6357- 008 -026, 8014 Telegraph Road/ APN 6367- 008 -003, and 8434 Tweedy Lane/
APN 6367-008-004 (hereinafter "subject property ") owned respectively by Ramco
Investments Co., Frank & Rita Giovinetti, Dolphin Assoc. Ltd. (hereinafter "applicant ")
from "Office" to "Medium Density Residential ".
B. On December 4, 2002, the Downey Planning Commission held a duly noticed public
hearing and, after fully considering all oral and written testimony and facts and opinions
offered at the aforesaid public hearing, and adopted Resolution No. 2253, recommending
approval of General Plan Amendment No. 02 -77 by the City Council.
C. On January 28, 2003, the Downey City Council held a duly noticed public hearing and,
after fully considering all oral and written testimony and facts and opinions offered at the
aforesaid public hearing, and adopted Resolution No. 6 6 2 9 approving General Plan
Amendment No. 02 -77.
SECTION 2. Having considered all of the oral and written evidence presented to it at
said public hearings, the City Council, pursuant to suggested criteris set by Chapter 3 (Page 36)
of the State General Plan Guidelines, further finds, determines, and declares that:
1. The proposed reclassification form "Office" to "Medium Density Residential" is in the
public interest and in the interest of the furtherance of the public health, safety, and
welfare. The proposed "Medium Density Residential" designation is compatible and
complementary to existing conditions, since two of the three subject properties are
occupied by residential uses, and adjoining properties, since several properties along
the Telegraph Road corridor to the east and west of the subject properties are zoned and
developed with apartments. The proposed reclassification will minimize the impacts
onto adjacent residential areas by eliminating the potential for the development of the
site with commercial uses.

2. The proposed reclassification is consistent with all other parts of the general plan and
will help the City achieve the goals of the Housing, and Economic Development
chapters of Downey Vision 2010, the city's general plan. The proposed reclassification
will enable the construction of additional residential units, will help the City towards
meeting the housing needs of its residents, and is consistent with Policy 2.2. of the
Housing Chapter which states " The City shall encourage infill development and
recycling of land to provide adequate residential sites." The proposed reclassification,
which will replace the commercial designation of the subject property with a residential
designation is consistent with Program 9.6.1.2. of the Economic Development Chapter,
which states "phase out selected strip commercial areas."
3. No changes to other parts of the general plan are necessitated by the proposed general
plan amendment since the amendment is consistent with the goals, policies, and
programs of the general plan.
4. Changes to zoning necessitated by the proposed amendment will be implemented
within a reasonable time. A zone change application to re -zone the three properties
from C -2 & P -B and R -1 5000 to a zone that is consistent with the proposed "Medium
Density Residential" designation has been filed and will be considered concurrently
with the general plan amendment application.
SECTION 3. The City Council finds, determines, and declares that General Plan
Amendment No. 02 -77 will not have significant adverse effects on the environment. An initial
study of the proposed project was prepared, in accordance with the provisions of the California
y p p p J p p p
Environmental Quality Act (CEQA), and indicated that there will be no significant impact on the
environmental. Accordingly, a Negative Declaration of Environmental Impact has been prepared
for General Plan Amendment No. 02 -77.
SECTION 4. Based upon the findings set forth in Sections 1, 2, and 3 of this Resolution,
the City Council of the City of Downey hereby adopts the Negative Declaration of
Environmental Impact prepared for General Plan Amendment No. 02 - 77. --
SECTION 5. Based upon the findings set forth in Sections 1, 2 and 3 of this Resolution,
the City Council of the City of Downey hereby approves an amendment to the General Plan Land
Use Diagram, changing the land use designations for the three properties located at 8000
Telegraph Road, 8014 Telegraph Road, and 8434 Tweedy Lane from "Office" to "Medium
Density Residential ".
SECTION 6. The City Clerk shall certify the adoption of this Resolution and cause the same
to be published in the manner prescribed by law.
