HomeMy WebLinkAboutResolution No. 6575 RESOLUTION 6 5 7 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE MEMORANDUM OF UNDERSTANDINGS BETWEEN THE CITY OF DOWNEY AND THE DOWNEY CITY EMPLOYEES' ASSOCIATION/ MAINTENANCE UNIT, / MISCELLANEOUS UNIT AND THE DOWNEY PUBLIC SAFETY AUXILIARY ASSOCIATION; AND AMENDING RESOLUTION 5515 THE MANAGEMENT AND CONFIDENTIAL EXEMPT BENEFITS PLAN WHEREAS, the City has met its obligation to meet and confer pursuant to the Myers- Milias- Brown Act and Employee Relations Ordinance No. 394; and WHEREAS, the City and the Associations have reached agreement; and WHEREAS, the City and the Association have memorialized the agreement in a written amendment to their respective Memorandum of Understandings; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Amendment to the Memorandum of Understanding between the City of Downey and the Downey City Employees' Association/ Miscellaneous Unit, attached hereto, is hereby approved in substantially the form thereof together with any additions thereto or changes therein deemed necessary or advisable by the City Manager. SECTION 2. The Amendment to the Memorandum of Understanding between the City of Downey and the Downey City Employees' Association/ Maintenance Unit, attached hereto, is hereby approved in substantially the form thereof together with any additions thereto or changes therein deemed necessary or advisable by the City Manager. SECTION 3. The Amendment to the Memorandum of Understanding between the City of Downey and the Downey Public Safety Auxiliary Association, attached hereto, is hereby approved in substantially the form thereof together with any additions thereto or changes therein deemed necessary or advisable by the City Manager. SECTION 4. The Amendment to Resolution 5 515 — Management and Confidential/Exempt Benefits Plan attached hereto, is hereby approved in substantially the form thereof together with any additions thereto or changes therein deemed necessary or advisable by the City Manager. Salary IncreaseslAdjustments. C. Salary Increase. If any employee group is granted a salary increase greater than 3.28% between July 1, 2002 and June 30, 2003, then the difference between that salary increase and 3.28% will be granted to employees covered by this MOU. Such salary increase will be effective October 28, 2002. The salary increase granted shall not exceed .72 %. Article XII Retirement Section 4. PERS Coverage. The City agrees to amend the PERS contract to provide the benefit known as 2.7% @ age 55 effective on or around August 19, 2002, provided a positive ratification -vote occurs as required by PERS law. Section 5. Employer Paid Member Contribution A. When the 2.7% @ age 55 PERS contract amendment is effective (estimated as August 19, 2002), the City agrees to "pick -up" the additional one percent employee contribution required under PERS law. B. The parties acknowledge that there is a cost in providing 2.7% @ Age 55. The PERS actuary has calculated the "change to normal cost" to be 2.280% of salary. The Association agrees that if the employer rate increases above 2.280 %, then effective the date of the rate adjustment the deduction for the employee contribution to PERS will increase by a corresponding amount. The City agrees that should a PERS Actuary later determine that the "change to normal cost" be Tess than 2.280 %, then the City will increase the employee's salary by an equal amount. ARTICLE XXV TERM OF MEMORANDUM OF UNDERSTANDING The term of this memorandum of understanding shall be extended from October 31, 2002 and shall continue in full force and effect until October 31, 2003.
