A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
IN SUPPORT OF SENATE BILL 1342 (MORROW) TO DEFINE THE
MAXIMUM EXTENT PRACTICABLE STANDARD IN THE STATE
WATER CODE
WHEREAS, the City of Downey is a permittee under Waste Discharge Requirements and

National Pollutant Discharge Elimination System (NPDES) Permit for Municipal Storm Water and

Urban Runoff Discharges in the County of Los Angeles (Order No. 01 -182 NPDES NO.
CAS004001) approved by the Regional Water Quality Control Board, Los Angeles Region, on

December 13, 2001; and
WHEREAS, the City of Downey supports appropriate and cost effective measures that will
reduce pollutants to the maximum extent practicable; and
WHEREAS, the NPDES Permit requirements extend beyond the maximum extent
practicable standard requiring permittees to assure that storm water discharges shall neither cause
nor contribute to the exceedance of water quality standards and objectives nor create conditions of
nuisance in the receiving waters, and that the discharge of non -storm water be effectively prohibited;
and

WHEREAS, the City of Downey believes that municipalities could be held responsible,
through enforcement actions and third party citizen lawsuits, for any exceedance in urban runoff,
including the existence of trash in our water ways unless the maximum extent practicable standard

is appropriately defined; and
WHEREAS, the City of Downey believes that Senate Bill 1342 would appropriately define

the maximum extent practicable standard consistent with Title 33 of the United States Code by
amending the State Water Code and would require that permits issued by the State Water Resources
Control Board and California Regional Water Quality Control Boards for discharges from municipal

storm drains conform to the maximum extent practicable standard.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS:
SECTION 1. To fully support Senate Bill 1342.
SECTION 2. That the Mayor shall sign and the City Clerk shall certify to the passage and

adoption of this Resolution and thereupon the same shall take effect and be in force.
