HomeMy WebLinkAboutResolution No. 6526 RESOLUTION NO. 6526 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE REVISED HOUSING ELEMENT TO THE CITY'S GENERAL PLAN 2020 AS COMPLIANT WITH STATE LAW AND THE ADOPTION OF THE NEGATIVE DECLARATION AS SATISFYING THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT GENERAL PLAN AMENDMENT No. 01 -87 THE CITY COUNCIL OF THE CITY OF DOWNEY DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find, determine and declare that: A. That the City of Downey initiated a General Plan Amendment to update its comprehensive housing element as mandated by the State of California Department of Housing and Community Development (HCD) for the planning period 2000 -2005; B. The Planning Commission held a duly noticed public hearing on November 20, 2001, and fully considered all oral and written testimony and facts and opinions offered at the aforesaid public hearing, adopted Resolution No. 2170, recommending approval of the General Plan Amendment to the Housing Element to the City Council; C. On November 29, 2001, HCD notified the City its acceptance of the revisions to the draft element submitted on October 29, 2001 and stated if adopted in its current form, will comply with State housing element law (Article 10.6 of the Government Code); and D. The City Council held a duly noticed public hearing on December 11, 2001 and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, adopted Resolution No. 6526, approving General Plan Amendment No. 01 -87. SECTION 2. Having considered all of the oral and written evidence presented to it at said public hearings, the City Council further finds, determines and declares that: A. The Housing Element is consistent with good planning practice, necessary and desirable for the development of the community and necessary for the preservation of the public health, safety and general welfare of the City of Downey; B. In taking this action, the City Council has considered the effects of the decision on the housing needs of the region in which the City is located, and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources; and Page 2 Resolution No. 6526 Downey City Council C. A Negative Declaration of Environmental Evaluation has been prepared for the Housing Element in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines and the City of Downey's Revised Environmental Procedures and finds there is no substantial evidence that the Housing Element will have a significant adverse effect upon the environment. SECTION 3. Based on the findings set forth in Section 1 and 2 of this Resolution, the City Council of the City of Downey hereby approves General Plan Amendment No. 01- 87. SECTION 4. Based upon findings set forth in Section 1, 2, and 3 of this Resolution, the City Council of the City of Downey hereby adopts the Negative Declaration of Environmental Impact for this application. SECTION 5. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 11TH day of December, 2001. MEREDITH H. PERKINS, Mayor ATTEST: KATHLEEN L.
