HomeMy WebLinkAboutResolution No. 6509 RESOLUTION NO. 6509 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING A REQUEST TO AMEND THE DOWNEY MUNICIPAL CODE TO ADD SELF - STORAGE FACILITIES AS ALLOWED USES, SUBJECT TO A CONDITIONAL USE PERMIT IN THE C -3 (CENTRAL BUSINESS DISTRICT) ZONE CODE AMENDMENT NO. 01 -24 THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find, determine, and declare that: A. On December 6, 2000, the Downey Planning Commission adopted a minute action to initiate an application to amend Section 9126 of the Downey Municipal Code, relating to the Central Business District (C -3) zone, adding self - storage /mini- warehouse facilities as allowed uses, subject to conditional use permits. B. On May 2, 2001 and continued to June 6, 2001 and July 18, 2001, the Downey Planning Commission held a duly noticed public hearing and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, and adopted Resolution No. 2123, recommending to the City Council the proposed code amendment, relating to self - storage facilities in the C -3 (Central Business District) zone. C. On August 14, 2001 and continued to August 28, 2001, the Downey City Council held a duly noticed public hearing and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, and adopted Resolution No. 6509 , denying the proposed code amendment relating to self- storage facilities in the C -3 (Central Business District) zone. SECTION 2. Having considered all of the oral and written evidence presented to it at said public hearings, the City Council further finds, determines and declares that: 1. The proposed code amendment to allow self- storage in the C -3 zone is in conflict with the goals, policies, and programs of the Downey General Plan. Resolution No. 6509 Page 2 2. The proposed code amendment to allow self - storage in the C -3 zone will negatively affect the health, safety, and welfare of the City of Downey since the impacts from self - storage uses are different from impacts from commercial uses allowed in the Central Business District, C -3, zone. 3. The proposed code amendment to allow self - storage in the C -3 zone could lead to a proliferation of self- storage uses within all commercial zones because it would redefine self- storage, currently an industrial use, as a use consistent with commercial designations in the Downey General Plan. 4. Self- storage, as an industrial use, is not the highest and best use for properties in the C -3 zone and is inconsistent with the recent revitalization of the Downtown Downey/ Firestone Boulevard area. 5. The proposed code amendment to allow self- storage, an industrial use, in a commercial zone is contrary to General Plan Policy 1.2.1: "The City shall strive to retain a relative balance of land uses" since adequate numbers of industrially -zoned properties are available for self- storage in the City under present zoning and general plan designations. 6. An Initial Study (IS) of Environmental Impact and Negative Declaration (ND) were prepared for Code Amendment No. 01 -24, in accordance with the provisions of the California Environmental Quality Act (CEQA), state CEQA Guidelines, and City of Downey's Procedures for Implementing CEQA; and 7. A public hearing was held by the City Council of the City of Downey, at which time evidence was heard on the Initial Study and Negative Declaration prior to considering the project. SECTION 3. Based upon the findings set forth in Sections 1 and 2 of this Resolution, the City Council of the City of Downey hereby denies Code Amendment No. 01-24. SECTION 4. The City Clerk shall certify the adoption of this Resolution.
