A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE
LAND USE ELEMENT OF THE DOWNEY GENERAL PLAN AND RE- CLASSIFYING
PROPERTY AT 10221 DOWNEY AVENUE FROM "LOW DENSITY RESIDENTIAL" TO
"OFFICE" AND ADOPT A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT
(ASSESSOR PARCEL NUMBER 6252- 021 -016).
GENERAL PLAN AMENDMENT NO. 01 -41
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine and
declare that:
A. An application was filed with the City Planning Department by Mr. Thomas
McIntyre (hereinafter "Applicant ") for the City Planning Commission to
recommend approval to the City Council General Plan Amendment No. 01 -41
requesting to amend the Land Use Element of the Downey General Plan from
Low Density Residential to Office for property located at 10221 Downey Avenue
(Assessors Parcel Number 6252 - 021 -016) (hereinafter "Subject Site ");
B. The applicant has also concurrently applied for Zone Change No. 01 -42 for the
Subject Site;
C. The Downey Planning Commission held a duly noticed public hearing on June 6,
2001, and, after fully considering all oral and written testimony and facts and
opinions offered at the aforesaid public hearing, adopted Resolution No. 2129,
recommending approval of the General Plan Amendment to the City Council;
and
D. The City Council help a duly noticed public hearing on July 10, 2001 and, after
fully considering all oral and written testimony and facts and opinions offered at
the aforesaid public hearing, adopted Resolution No. 6496 approving
General Plan Amendment No. 01 -42.
SECTION 2. Having considered all of the oral and written evidence presented to it at
said public hearings, the City Council further finds, determines and declares that:
A. The amendment and revision to the Downey General Plan as recommended in
this resolution is consistent with good planning practice, necessary and desirable
for the development of the community and necessary for the preservation of the
public health, safety and general welfare of the City of Downey;
B. In taking this action, the Planning Commission has considered the effects of the
decision on the housing needs of the region in which the City is located, and
balanced those needs against the public service needs of the City residents and
available fiscal and environmental resources;

C. A Negative Declaration of Environmental Evaluation has been prepared for this
General Plan Amendment in accordance with the provisions of the California
Environmental Quality Act, the State CEQA Guidelines and the City of Downey's
Revised Environmental Procedures;
D. Prior to recommending this General Plan Amendment, the Planning Commission
considered the Negative Declaration of Environmental Evaluation together with
any comments received during the public review process and the hearings; and
E. Based upon the Negative Declaration of Environmental Evaluation and any
comments received in the public review process, there is no substantial evidence
that the General Plan Amendment will have a significant adverse effect upon the
environment.
SECTION 3. Based on the findings set forth in Section 1 and 2 of this Resolution, the
City Council of the City of Downey hereby approves General Plan Amendment No. 01-
41.
SECTION 4. Based upon findings set forth in Section 1, 2, and 3 of this Resolution, the
City Council of the City of Downey hereby adopts the Negative Declaration of
Environmental Impact for this application.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
