A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY OPPOSING THE IMPLEMENTATION OF
ASSEMBLY BILL 1015 (AB1015) WHICH WOULD LIMIT THE
POLICE CHIEF'S ABILITY TO DISCIPLINE EMPLOYEES FOR
LAWFUL CONDUCT THAT OCCURRED OFF THE PREMISES
OF THE EMPLOYER AND OUTSIDE THE PERSON'S HOURS
OF EMPLOYMENT.
SECTION 1. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY
RESOLVE AS FOLLOWS:
A. Assembly Bill 1015 (AB 1015) (Wright) has been proposed and would severely
limit law enforcement management's ability to govern the off -duty conduct of their
employees.
B. AB 1015 would establish laws making it an "unlawful employment practice" to
refuse to hire, reassign, or otherwise discipline or counsel an employee based
upon the employee's "lawful conduct that occurred off the premises of the
employer, or a prior employer, and outside the person's hours of employment."
C. If AB 1015 were to become law, an agency's authority to regulate off -duty
employment of its officers could be severely compromised.
SECTION 2. The City Council of the City of Downey hereby desires to make
known its opposition to AB 1015 and requests that our duly appointed legislatures
oppose passage of this bill.
That the City Clerk shall certify to the adoption of this Resolution
APPROVED AND ADOPTED this 13th day of March , 2001.
