HomeMy WebLinkAboutResolution No. 6393 RESOLUTION NO. el A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING GENERAL PLAN AMENDMENT NO. 00-57 CHANGING THE GENERAL PLAN DESIGNATION FROM NEIGHBORHOOD COMMERCIAL TO GENERAL COMMERCIAL FOR PROPERTY LOCATED AT 8830 -66 ROSECRANS AVENUE AND 14305 -37 LAKEWOOD BOULEVARD ,.� (CITY INITIATED) THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find, determine and declare that: A. The City Council initiated an amendment to change the General Plan Designation from Neighborhood Commercial to General Commercial for the property located at 8830 -66 Rosecrans Avenue and 14305 -37 Lakewood Boulevard, City of Downey (hereinafter "Subject Property "). B. The Planning Commission held a duly noticed public hearing on July 19, 2000 and after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, adopted Resolution No. 2073, recommending to the City Council the adoption of this resolution changing the General Plan designation for the Subject Property. C. The City Council held a duly noticed public hearing on August 22, 2000 concerning this resolution and fully and carefully considered all oral and written testimony and all facts and opinions offered at the aforesaid public hearing prior to adopting this resolution. D. The amendment and revision to the Downey General Plan as recommended in this resolution is consistent with good planning practice, necessary and desirable for the development of the community and necessary for the preservation of the public health, safety and general welfare of the City of the Downey, because the property to the north and the properties in the City of Paramount, south of the site, are able to support General Commercial uses and it is evident that the subject site could also support General Commercial uses. E. In taking this action, the City Council has considered the effects of the decision on the housing needs of the region in which the City is located, and balanced those needs against the public service needs of the city residents and available fiscal and environmental resources. r—. A Negative Declaration of Environmental Evaluation has been prepared for this General Plan Amendment in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines and the City of Downey's Revised Environmental Procedures. G. Prior to recommending this amendment to the General Plan, the City Council considered the Negative Declaration of Environmental Evaluation together with any comments received during the public process and the hearings. H. Based upon the Negative Declaration of Environmental Evaluation and any comments received in the public review process, there is no substantial evidence that the General Plan Amendment will have a significant adverse effect upon the environment. SECTION 2. The City Council hereby amends the General Plan of the City of Downey by adopting General Plan Amendment #00 -57 changing the General Plan Designation from Neighborhood Commercial to General Commercial on the properties located at 8830 -66 Rosecrans Avenue and 14305 -37 Lakewood Boulevard, the area bounded by Lakewood Boulevard, Rosecrans Avenue and Century Boulevard. SECTION 3. City Council adopt the Negative Declaration of Environmental Impact. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
