HomeMy WebLinkAboutResolution No. 6369 RESOLUTION NO. 6369 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY TO ADOPT GENERAL PLAN AMENDMENT NO. 00-16 TO THE LAND USE ELEMENT OF THE DOWNEY GENERAL PLAN TO RE- CLASSIFY SIX (6) LOTS FROM THE "NEIGHBORHOOD COMMERCIAL" LAND USE DESIGNATION TO THE "COMMERCIAL- MANUFACTURING" LAND USE DESIGNATION ON PROPERTIES LOCATED AT 12432 -12530 BELLFLOWER BOULEVARD, AND 9501 -45, 9557 -61, 9607, 9623, 9637, 9641 IMPERIAL HIGHWAY ZONED LIGHT MANUFACTURING (M -1), GENERAL MANUFACTURING (M -2), AND PARKING- BUFFER (P -B), AND ADOPT A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find, determine and declare that: A. An application was filed by Eric Peterson (hereinafter "Applicant ") requesting to amend the Land Use Element of the Downey General Plan to re- classify from the "Neighborhood Commercial" land use designation to the "General Manufacturing" land use designation on property located at 9641 Imperial Highway (APN 6263- 003 -008) Downey, California and zoned Light Manufacturing (M -1), General Manufacturing (M -2), and Parking -Buffer (P -B). B. On January 19, 2000, the Downey Planning Commission adopted a minute action to initiate the requested General Plan Amendment (GPA) but to include a total of six (6) lots (hereinafter "subject area ") located at 9501 -45 Imperial •■•N Highway & 12432 -12530 Bellflower Boulevard (APN 6283- 003 -017), 9557 -61 Imperial Highway (APN 6283- 003 -012), 9607 Imperial Highway (APN 6283 -003- 011), 9623 Imperial Highway (APN 6283 -003 -010), 9637 Imperial Highway (APN 6283- 003 -800), 9641 Imperial Highway (APN 6263- 003 -008), and zoned Light Manufacturing (M -1), General Manufacturing (M -2), and Parking -Buffer (P -B). C. On May 3, 2000, the Downey Planning Commission held a duly noticed public hearing, and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, modified the request to re- classify the subject area to the "Commercial Manufacturing" land use designation, and adopted Resolution No. 2042, recommending approval of the general plan amendment by the City Council. D. On June 13, 2000, the Downey City Council held a duly noticed public hearing and, after fully considering all oral and written testimony and facts and opinions offered at the aforesaid public hearing, adopted Resolution No. 6369 re- classifying the six (6) lots to the "Commercial Manufacturing" land use designation. Having considered all of the oral and written evidence presented to it at said public hearings, the City Council further finds, determines and declares that: 1. This amendment and revision to the Downey General Plan, as recommended in this resolution, is consistent with good planning practice, necessary and desirable for the development of the community and necessary for the preservation of the public health, safety, and general welfare of the City of Downey; and 7 2. This amendment to re- classify the subject area to the "Commercial Manufacturing" land use designation is compatible and complementary to existing conditions and adjoining property in the surrounding area, since the existing land use mix on the properties in the area already consist of commercial and manufacturing uses; and 3. This amendment to re- classify the subject area to the "Commercial Manufacturing" land use designation will not result in a significant negative impact upon the surrounding properties, since impacts identified to occur as a result of this request will be Tess significant than impacts identified to occur without the request; and 4. The Planning Commission has considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the City residents and available fiscal and environmental resources; and 5. An Initial Study (IS) of Environmental Impact and Negative Declaration (ND) were prepared for General Plan Amendment No. 00 -16, in accordance with the provisions of the California Environmental Quality Act (CEQA), state CEQA Guidelines, and City of Downey's Procedures for Implementing CEQA; and 6. A public hearing was held by the Planning Commission of the City of Downey on May 3, 2000, at which time evidence was heard on the Initial Study and Negative Declaration prior to recommending approval of the project. 7. A public hearing was held by the City Council of the City of Downey on June 13, 2000, at which time evidence was heard on the Initial Study and Negative Declaration prior to approving the project. SECTION 3. Based upon the findings set forth in Sections 1 and 2 of this Resolution, the City Council of the City of Downey hereby approves General Plan Amendment No. 00 -16. SECTION 4. Based upon the findings set forth in Sections 1 and 2 of this Resolution, the City Council of the City of Downey hereby adopts the Negative Declaration of Environmental Impact for this application.
