HomeMy WebLinkAboutResolution No. 6367 RESOLUTION NO. 6367 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE MITIGATED NEGATIVE DECLARTION FOR THE TRANSIT CENTER AT DOWNEY AVENUE AND NANCE STREET. THE CITY COUNCIL DOES RESOLVE AS FOLLOWS: Section I. The City Council of the City of Downey does hereby find, determine and declare as follows: A. The City of Downey has submitted an application for funds to the Federal Transit Administration, Section 5309 program for funding to support the design and construction of a transit center at Downey Avenue and Nance Street, including the purchase of the property at this site for purposes of constructing a bus transfer facility. B. The proposed project would sit on an unimproved 1.49 acre site at Downey Avenue and Nance Street and support the construction of a 2,227 square foot building, parking and waiting areas for up to seven Large buses and two Bial- a -ride vehicles; a drop -off area and employee parking. The site is intended to serve primarily pedestrians from the downtown area and transfer passengers from transit. C. The City of Downey, as Lead Agency for this project, has caused to be prepared an Initial Study of Environmental Impacts (Initial Study) and Mitigated Negative Declaration for the project pursuant to the California Environmental Quality Act (CEQA) of 1970, as amended, the state CEQA Guidelines and the City of Downey's Revised Procedures for Implementing CEQA, which were adopted by City Council Resolution No. 5646. Although the City of Downey had assistance in preparing the Initial Study, the Initial Study and proposed Mitigated Negative Declaration reflect the independent judgement of the City of Downey. D. The Initial Study and proposed Mitigated Negative Declaration evaluated the probable and potential environmental effects of the development and operation of the proposed project. E. In accordance with CEQA, the Initial Study and Mitigated Negative Declaration were distributed to the appropriate public agencies and were made available for public review and comment for a period of twenty days, ending May 30 2000. F. The City Council will conduct a public hearing at its regular meeting of June 13, 2000 at which time evidence is heard on the Initial Study and the proposed Mitigated Negative Declaration. G. The City Council fully reviewed and carefully considered the Initial Study and proposed Mitigated Negative Declaration, together with comments received during the public review period and during the public hearing; RESOLUTION NO. 6367 H. That revisions to the project proposal, including mitigation measures, agreed to by the City would avoid the effects or mitigate the effects to a point where clearly no significant effects would occur; and therefore I. There is no substantial evidence in Tight of the whole record before the City that the project as revised or mitigated, may have a significant effect on the environment. Section II. That the City Council of the City of Downey hereby approves the Mitigated Negative Declaration, since the actions are complete and adequate and the Mitigated Negative Declaration was prepared in compliance with the requirements of CEQA, the state CEQA Guidelines and the City's Revised , Procedures for Implementing CEQA. The Director of Community Services is hereby directed to file the Notice of Determination for the environmental document with the County Clerk of the County of Los Angeles.
