A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING GENERAL PLAN AMENDMENT NO. 99-42,
CHANGING THE GENERAL PLAN DESIGNATION FROM NEIGHBORHOOD
COMMERCIAL TO GENERAL COMMERCIAL FOR PROPERTY
LOCATED AT 13535 LAKEWOOD BOULEVARD, DOWNEY
(APPLICANT: RICH DEVELOPMENT)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine
and declare that:
A. An application has been filed by Mr. Tab Johnson of Rich Development
(hereinafter "Applicant ") forr a change in the General Plan Designation from
Neighborhood Commercial to General Commercial for the property located
at 13535 Lakewood Blvd., City of Downey (hereinafter "Subject Property").
B. The Planning Commission held a duly noticed public hearing on December
1, 1999 and fully considered all oral and written testimony and facts and
opinions offered at the aforesaid public hearing, and adopted Resolution
No. 2014 recommending to the City Council the adoption of this resolution
changing the General Plan Designation for the Subject property.
C. The City Council head a duly noticed public hearing on January 11, 2000
concerning this resolution and fully and carefully considered all oral and
written testimony and all facts and opinions offered at the aforesaid public
hearing prior to adopting this resolution.
D. The amendment and revision to the Downey General Plan as
recommended in this resolution is consistent with good planning practice,
necessary and desirable for the development of the community and
necessary for the preservation of the public health, safety and general
welfare of the City of Downey, and the properties in the City of Paramount,
south of the site, are able to support General Commercial uses and it is
evident that the subject site could also support General Commercial uses.
E. In taking this action, the City Council has considered the effects of the
decision on the housing needs of the region in which the City is located,
and balanced those needs against the public service needs of the city
residents and available fiscal and environmental resources.
F. A Mitigated Negative Declaration of Environmental Evaluation has been
prepared for this General Plan Amendment in accordance with the
provisions of the Califomia Environmental Quality Act, the State CEQA
Guidelines and the City of Downey's Revised Environmental Procedures.
G. Prior to recommending this amendment to the General Plan, the City
Council considered the Mitigated Negative Declaration of Environmental
Evaluation together with any comments received during the public review
process and the hearings.

H. Based upon the Mitigated Negative Declaration of Environmental
Evaluation and any comments received in the public review process, there
is no substantial evidence that the General Plan Amendment will have a
significant adverse effect upon the environment.
SECTION 2. The City Council hereby amends the General Plan of the City
of Downey by adopting General Plan Amendment #99 -42 changing the General
Plan Designation from Neighborhood Commercial to General Commercial on
property located at 13535 Lakewood Boulevard, Assessor Parcel Nos. 6266 -003-
019, 020, 022. 0,,,■
SECTION 3. The City Council adopts the Mitigated Negative Declaration of
Environmental Impact.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
