A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY TO ADOPT GENERAL PLAN AMENDMENT NO.
99-55 TO THE HOUSING CHAPTER TO ESTABLISH
SECOND UNIT DEVELOPMENT AREA NO. 24 TO INCLUDE
PROPERTIES LOCATED AT 11460-62 RIVES AVENUE,
1146466 -68 RIVES AVENUE, AND 7824 BURNS, ZONED
SINGLE FAMILY RESIDENTIAL, R-1 5000, AND TO ADOPT
A NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find, determine
and declare that:
A. An application was filed by Charles Freberg (hereinafter "Applicant ")
requesting to expand one of the three dwelling units located on the
property at 11464 -66 -68 Rives Avenue, Downey, Califomia located in the
R -1 5000 zone.
B. On July 7, 1999, the Downey Planning Commission adopted a minute
action to initiate a General Plan Amendment (GPA) to the Housing
Element of the Downey General Plan to establish a second unit
development (SUD) area to include the properties at 11440, 11446,
11450, 11454, 11460, and 11464 Rives Avenue, and 7824 Bums Avenue
(hereinafter "subject site ").
C. On August 18, 1999, the Downey Planning Commission held a duly
noticed public hearing and, after fully considering all oral and written
testimony and facts and opinions offered at the aforesaid public hearing,
adopted Resolution No.1983 recommending approval of the general plan
amendment by the City Council to establish a second unit development
(SUD) area to include properties at 11460 Rives Avenue, 11464 Rives
Avenue, and 7824 Bums Avenue (hereinafter "proposed area ").
D. On September 28, 1999, the Downey City Council held a duly noticed
public hearing and, after fully considering all oral and written testimony
and facts and opinions offered at the aforesaid public hearing, adopted
Resolution No. 6300 establishing Second Unit Development Area No. 24
to include properties at 11460 Rives Avenue, 11464 Rives Avenue, and
7824 Bums Avenue (APN 6247- 003 -001, 6247 - 003-002, 6247 -002 -036).

SECTION 2. Having considered all of the oral and written evidence presented to
it at said public hearings, the City Council further finds, determines and declares
that
1. This amendment and revision to the Downey General Plan, as
recommended in this resolution, is consistent with good planning practice,
necessary and desirable for the development of the community and
necessary for the preservation of the public health, safety, and general
welfare of the City of Downey; and
2. This amendment to create a new second unit development area is
compatible and complimentary to existing conditions and adjoining
property in the surrounding area, since properties in the area already have
more than one dwelling unit, second unit developments will not result in a
density greater than that of the underlying and surrounding R -1 5000
zone, and lot shape and size is different than the standard shapes and
sizes of surrounding R -1 zoned properties; and
3. This amendment to create a new second unit development area will not
result in a significant negative impact upon the surrounding single - family
residential neighborhood, since impacts identified are insignificant due to
the scale of the number of additional dwelling units allowed as a result of
this request; and
4. The City Council has considered the effects of the decision on the housing
needs of the region in which the City is located and balanced those needs
against the public service needs of the City residents and available fiscal
and environmental resources; and
5. An Initial Study (18) of Environmental Impact and Negative Declaration
(ND) were prepared for General Plan Amendment No. 99 -55, in
accordance with the provisions of the Califomia Environmental Quality Act
(CEQA), state CEQA Guidelines, and City of Downey's Procedures for
Implementing CEQA; and
6. A public hearing was held by the Planning Commission of the City of
Downey on August 18, 1999, at which time evidence was heard on the
Initial Study and Negative Declaration prior to approving the project.

September 28, 1999, at which time evidence was heard on the Initial
Study and Negative Declaration prior to approving the project.

ATTEST:
SECTION 3. Based upon the findings set forth in Sections 1 and 2 of this
Resolution, the City Council of the City of Downey hereby approves General
Plan Amendment No. 99-55.
SECTION 4. Based upon the findings set forth in Sections 1 and 2 of this
Resolution, the City Council of the City of Downey hereby adopts the Negative
Declaration of Environmental Impact for this application.
SECTION 5. The City Clerk shall certify the adoption of this Resolution.
