A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING THE FINDINGS OF THE BUILDING OFFICIAL TO JUSTIFY THE
LOCAL AMENDMENTS TO THE CALIFORNIA BUILDING STANDARDS
CODE, THE CALIFORNIA ELECTRICAL CODE, THE CALIFORNIA
PLUMBING CODE, THE UNIFORM SWIMMING POOL, SPA AND HOT TUB
CODE, THE CALIFORNIA MECHANICAL CODE , THE UNIFORM HOUSING
CODE AND THE CODE FOR THE ABATEMENT OF DANGEROUS
BUILDINGS FOR CLIMATIC, GEOGRAPHICAL OR TOPOGRAPHICAL
REASONS.
THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES, DETERMINES AND
ORDERS AS FOLLOWS:
WHEREAS, The Health and Safety Code of the State of California, Section 17958.5, limits the authority of
a city to establish more restrictive building standards reasonably necessary because of local climatic;
geological, or topographical conditions, and;

WHEREAS, Section 17985.7.of said Health and.SafetyCode requires that the governing body of the city
make an expressed finding for each local amendment, and;
Whereas, said Section 17985.7 requires that the local amendments and findings shall be filed with the
California State Building Standards Commission to be effective on the filing date, and;
WHEREAS, the findings and local amendments apply to all occupancies, unless specified otherwise, and;
WHEREAS, the following justifications for the proposed amendments to the California Building Code
have been prepared by the Building Official of the City of Downey:
SECTION I— AMENDMENTS. REVISIONS AND ADDITIONS TO THE CODES.
Section 106.2 — Exempted Work
Items 1, 2, 5, and 13 have been revised and the revisions are administrative in nature and are not a
building standard. Therefore, a justification is not required.
,^ Section 106.4.1— Flood Plain Management
This section restricts the issuance of a pennit until such hazard has been eliminated to the
satisfaction of the Building Official. This is a geological condition of the area.
Section 106.4.1.1 through 106.4.1.1.5— Improvement of Vacant Property
This section was added to the previous adoption of the municipal code. This will amend the
current issue of the municipal code. It is administrative in nature and is not a building standard.
Therefore, a justification is not required.
Section 106.4.1.2 — Demolition Permits
This section was amended and the amendments are administrative in nature and are not a
building standard. Therefore, a justification is not required.
ection 106.4.1.3 — Qualifications c i Permittee
This section was amended and the amendments are administrative in nature and are not a building
standard. Therefore, a justification is not required.
Scction 107.1 through 107.3 — Permit and Plan Review Fees
This section was revised and the revisions are administrative in nature and are not a building
standard. Therefore, a justification is not required.
RESOLUTION NO. 6287
Section 108.6 — Special Inspectors
This section was amended. The amendments are administrative in nature and are not a building
standard. Therefore, a justification is not required.
Section 3103 — Temporary Structures
This section amends the new code with a section that was previously approved by Ordinance
1010, approved 12- 12 -95. The amendments are administrative in nature and are not a building
standard. Therefore a justification is not required.
Section 3304 — Maintenance of Materials of Construction
This amendment regulates the construction practices at a building site. One of the provisions of
this section addresses dust control and spray painting. Southern California is subject to Santa Ana
wind conditions and the strong winds could create a deleterious effect on the community if these
construction sites are not controlled. This amendment is justified on the basis of a climatic
condition.
Appendix Chapter 4, Section 421— Swimming Pool Barriers
This section has been amended to ensure a more effective barrier around pools and spas. Due to
the mild climate year -round in Southern California, poets and spas are used year - round. The
requirement for adequate barriers is justified on the basis of a climatic condition.
Appendix Chapter 33, Section 3310 - Grading Feet
The amendment to Section 3310 revises the permit fee requirements based on a separate resolution
by the City Council. This amendment is administrative in nature and is not a building standard.
Therefore, a justification is not required.
Appendix Chapter 33, Section 3319 — Pavement Requirements
The amendment to Section 3319 regulates drainage on site. This amendment is justified on the
basis of topographical conditions in Downcy.
Section 8104 — Aluminum Wiring
This amendment is administrative in nature and is not a building standard. Therefore, a
justification is not required.
Section 8105 — Service Panel Requirements
This amendment is administrative in nature and is not a building standard. Therefore, a
justification is not required.
SECTION II— SEVERABILITY.
The City Council declares that, should any provision, section, paragraph, sentence or word of this
Resolution of the Codes hereby adopted be rendered or declared invalid by any final court action in a court
of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections,
paragraphs, sentences and words of this Resolution and the Codes hereby adopted shall remain in full force
and effect.
SECTION 111,
The City Clerk shall certify to the adoption of this Resolution.
