HomeMy WebLinkAboutResolution No. 6048 RESOLUTION NO. 6048 A RESOLUTION OF THE CITY OF DOWNEY PROTESTING THE SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS DISTRICT 25 ELECTION HELD ON APRIL 14, 1997 WHEREAS, the Mayor and Members of the Downey City Council unanimously support �-, the candidacy of Councilmember Keith McCarthy to be the District 25 Representative to the Southern California Association of Governments (SLAG) Regional Council; and WHEREAS, SCAG's District 25 is comprised of the cities of South Gate and Downey; and WHEREAS, on April 14, 1997, SCAG conducted an election for District 25 which did not comply with the provisions of the SCAG Bylaws in that: (1) the election was not limited to the governing board members of the Council of Governments; (2) notice was not communicated to eligible candidates thirty (30) days prior to the date and time of the election; (3) SCAG was not required to hold the election in Cerritos prior to the Council of Governments meeting; and (4) the election should have occurred one (1) month prior to the General Assembly, which had been held in early April; and WHEREAS, the procedure followed in the election by SCAG was not the election procedure presented by a SCAG official at the February 10, 1997, Gateway Cities Council of Governments' Executive Committee; and WHEREAS, the City of Downey relied upon the election procedure presented by-the SCAG official at the February 10, 1997, Gateway Cities Council of Governments' Executive Committee, meaning that the regional council representatives would be chosen from among �-. the governing board of the Council of Governments; and WHEREAS, the City of Downey objects to the holding of an election involving the cities of South Gate and Downey in the City of Cerritos; and WHEREAS, a quorum of six Councilmembers should be required to hold an election among the City Councils of Downey and South Gate; and WHEREAS, only five Councilmembers attended the District 25 election in Cerritos, which should be one short of a quorum; and WHEREAS, it has been at least four years since the City of Downey has had a Downey Council representative on the SCAG Regional Council, even though the City is a full paying member. NOW, THEREFORE, the Downey City Council protests the District 25 Election conducted by SCAG and held in Cerritos, California on April 14, 1997, and demands that the SCAG Regional Council schedule a new election; and Resolution No. 6048 Page 2 THE DOWNEY CITY COUNCIL DEMANDS that all provisions of applicable State Law and SCAG bylaws be complied with in the conduct of any new election; and THE DOWNEY CITY COUNCIL STRONGLY RECOMMENDS that the SCAG Regional Council amend its bylaws to provide for the rotation of SLAG Board Representation among affected cities to avoid further bad will among member cities; and THE DOWNEY CITY COUNCIL DIRECTS the City Clerk to certify to the adoption of this Resolution and send certified copies of this Resolution to the President and District Representatives of the SCAG Regional Council and SCAG's Executive Director Mark Pisano.
