HomeMy WebLinkAboutResolution No. 5908 RESOLUTION NO. 59 0$ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FIRST AMENDMENT TO THE CITIES FOR USED OIL RECYCLING WORKING GROUP JOINT POWERS AGREEMENT TO ADD THE CITIES OF ARTESIA AND CYPRESS TO SAID WORKING GROUP. WHEREAS, therities of Bellflower, Bell Gardens, Downey, Gardena, Lakewood, Lawndale, and Montebello, collectively known as the "Working Group," entered into a Joint Powers Agreement on or about January 9, 1995; and WHEREAS, said Joint Powers Agreement created a regional used oil collection and promotion program in compliance with the California Oil Recycling Enhancement Act and further pursuant to the Joint Powers Law set forth in California Government Code Section 6500, et. seq. and other applicable law; and WHEREAS, the City of Artesia, a general law city, and the City of Cypress, a general law city, have expressed an interest in joining the Working Group; and WHEREAS, the Working Group has approved the First Amendment to the Cities for Used Oil Recycling Working Group Joint Powers Agreement in order to add the Cities of Artesia and Cypress as full members of the Working Group with equal entitlement, powers, compensation, funding, and obligations as applied to the original Working Group. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DOWNEY AS FOLLOWS: SECTION 1. That certain Joint Powers Agreement, entitled "Cities for Used Oil Recycling Working Group Joint Powers Agreement," dated January 9, 1995, is hereby amended by adding as members to said Joint Powers Agency the Cities of Artesia and Cypress which shall become full members of the Joint Powers Agency and members of the Working Group as referred to in the Joint Powers Agreement. SECTION 2. Each of the provisions of said Joint Powers Agreement relating to entitlement, powers, compensation, funding, and obligation of member cities shall apply equally to the Cities of Artesia and Cypress as said provisions originally applied to the Cities of Bellflower, Bell Gardens, Downey, Gardena, Lakewood, Lawndale, and Montebello, with the exception of the special provisions applicable to the City of Bellflower as Project Manager under the Joint Powers Agreement. SECTION 3. The Mayor, or presiding officer, is hereby authorized to affix his signature to this resolution signifying its adoption by the City Council of the City of Downey and the City Clerk, or her duly appointed deputy, is directed to attest thereto.
