A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS
INTO LIGHTING AND LANDSCAPING DISTRICT A.D. 121
AND TO FURNISH AND MAINTAIN ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES
LOCATED ON STREETS AND PUBLIC PLACES WITHIN
THOSE AREAS (ANNEXATIONS 95/01 THROUGH
95/09).
WHEREAS, the City Council of the City of Downey on July 11, 1995, adopted
Resolution No. 5891 declaring its intention to order certain improvements; and
WHEREAS, on July 11, 1995, the City Council by Resolution No. 5891, set
August 8, 1995, at 7:30 p.m. in the Council Chambers of the City Hall at 11111
Brookshire Avenue, Downey, California, as the time and place for hearing protests to
the proposed improvements; and
WHEREAS, on August 8, 1995, at the time and place specified, a public hearing
was held in accordance with Resolution No. 5891, notice having been given in the
manner required by law; and
WHEREAS, at the hearing the City Council did pass upon all written and oral
protests made in reference to the improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS;
SECTION 1. The boundaries of the areas to be annexed into Lighting and
Landscaping District A.D. 121 are shown on Drawing No. 95/01 through 95/09 and
described by a boundary description on file in the office of the City Clerk and by this
reference made a part hereto.
SECTION 2. The improvements consist of the installation of street lighting
standards and the furnishing of maintenance and energy for those street lights
described in the Engineer's Report dated July 11, 1995, as approved by the City
Council.
SECTION 3. The entire estimated cost of the improvements shall be borne by
the District and shall be paid by a special assessment charged against all the lands and
improvements within said area for the period beginning July 1, 1995.
SECTION 4. The improvements described in Resolution No. 5889 and the
Engineer's Report, submitted pursuant to said Resolution No. 5889 and approved by
Resolution No. 5890, shall be made in the manner and the time prescribed by law.

SECTION 5. The City Council finds that the Southern California Edison
Company, subject to the jurisdiction of the Public Utilities Commission of the State
of California, is the only contractor practically capable of serving the street lighting
improvements in the manner provided for and as described herein. It is, therefore,
ordered that the improvements of the Lighting District be carried out by the Southern
r--. California Edison Company in accordance with the Plans and Specifications.
SECTION 6. The Mayor is authorized and directed to execute the contract with
the Southern California Edison Company for the improvements in accordance with the
Plans and Specifications and in accordance with rates and rules filed by said Company
from time to time with the Public Utilities Commission of the State of California.
SECTION 7. The City Clerk shall certify to the adoption of the Resolution and
shall cause a copy of this Resolution to be published once in the designated
newspaper.
APPROVED AND ADOPTED THIS 8TH day of AUGUST 1995.
