A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ADOPTING A NONDISPOSAL FACILITY ELEMENT
IN ACCORDANCE WITH THE CALIFORNIA INTEGRATED
WASTE MANAGEMENT ACT OF 1989.
WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939 g g 939)
directs state and local agencies to enact and implement aggressive new integrated waste
management programs; and
WHEREAS, AB 939 calls for maximizing the use of all feasible source reduction,
,
recycling and composting options in order to reduce the amount of solid waste that must
be disposed of by transformation and land disposal;
WHEREAS, AB 939 directed cities and counties to prepare Source Reduction and
Recycling Elements identifying how source reduction, recycling, and composting programs
will be developed and implemented; and
WHEREAS, AB 2707 statutory requirements and criteria directed cities and

counties to prepare Household Hazardous Waste Elements and required cities to devote
reasonable expenditures to safe reduction, collection, recycling, treatment, and disposal
of Household Hazardous Waste, and that these collection programs be made available
for use by all households within_ city and county; and
WHEREAS, the City of Downey's Source Reduction and Recycling Element
(SRRE) and Household Hazardous Waste Element (HHWE) were adopted by the City
Council of the City of Downey on May 26, 1992, by Resolution No. 5557; and
WHEREAS, AB 3001 requires each city and each county to submit a Nondisposal
Facility Element (NDFE); and
WHEREAS, Section 41732 of the Public Resources Code provides requirements
and criteria for identifying new solid waste facilities, and for the expansion of existing solid
waste facilities which are needed to implement the SRRE.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Downey, as follows:
Section 1. The City Council of the City of Downey finds that the City has taken
the following actions;
A. The City of Downey's NDFE was prepared in accordance with AB 3001 and
Public Resources Code Sections 41732, 41733, and 41780; and

B. The City of Downey's NDFE was submitted to the County's Local Task Force
for review and comment; and
C. The City Council of the City of Downey held a noticed public hearing on
May 24, 1994, and has considered all public and agency comments with respect to r--�
Downey's NDFE.
Section 2. Based upon the findings contained in Section 1 of this Resolution, the
City Council hereby adopts the City of Downey's Nondisposa I Facility Element.
Section 3. The City Clerk shall certify to the adoption of this Resolution and shall
forward a copy of this Resolution to the California Integrated Waste Management Board.
