A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
IN SUPPORT OF H.R. 3948 - REAUTHORIZATION OF FEDERAL
CLEAN WATER ACT
WHEREAS, the County Sanitation Districts of Los Angeles County (the
Districts) provide wastewater collection treatment and disposal services for
the industrial and commercial section along with over 4 million residents of
Los Angeles County; and
WHEREAS, the Districts own and operate the Joint Water Pollution Control
Plant ( JWPCP) in Carson, California, which discharges treated wastewater into
the marine waters off the coast of Palos Verdes; and
WHEREAS, the JWPCP has a capacity of approximately 385 million gallons of
wastewater per day where approximately 60 percent of the waste receives
secondar y treatment and the remaining 40 percent receives advanced primary
treatment; and
WHEREAS, in 1979, the Districts in good faith applied for a waiver from
the secondary treatment requirements of the Clean Water Act pursuant to the
procedures established in Section 301(h) of the Act for municipalities
discharging to marine waters; and
WHEREAS, the U.S. Environmental Protection Agency finally denied the
waiver in 1991; and
WHEREAS, between 1972 and 1990, grants to municipalities were provided
under the Clean Water Act to assist in the financing of projects to upgrade
wastewater facilities to full secondary treatment; and
WHEREAS, the Districts would have been eligible for such grants; however,
such grants were not pursued because the Districts anticipated that a waiver
from full secondary treatment would be obtained; and
WHEREAS, in compliance with a binding consent decree, the Districts are
x developing a plan to install full secondary treatment at JWPCP at a cost of
approximately $400 million; and
WHEREAS, H.R. 3948 and its amendment in the nature of a substitute
sponsored by Congressman Mineta recognizes the need for the Federal Government
to assist the Districts with construction of full secondary treatment at
JWPCP; and
WHEREAS, the Federal assistance will also create additional jobs in
Southern California; and
WHEREAS, the bill is a balanced bipartisan approach to protecting our
nation's water resources.
NOW, THEREFORE, BE IT RESOLVED, THE CITY COUNCIL OF THE CITY OF DOWNEY
strongly endorses H.R. 3948 and its amendment in the nature of a susbstitute
and urges the Congress to enact this legislation in the current session.

SECTION 5. The City Clerk shall certify to the adoption of this
Resolution and provide for appropriate distribution thereof.
