HomeMy WebLinkAboutResolution No. 5793 RESOLUTION NO. 5793 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF THE SOUTHEASTERLY TEN FEET OF CORD AVENUE NORTHERLY FROM DOWNEY AND SANFORD BRIDGE ROAD. WHEREAS, the City Council of the City of Downey, upon recommendation of the Planning Commission, finds that the vacation of the southeasterly ten feet of Cord Avenue described herein serves the public benefit, it is necessary to vacate said street portion as shown on the attached map. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. It is necessary to vacate the portion of said street which is not useful to the General Public. SECTION 2. The public right -of -way being vacated in the City of Downey, County of Los Angeles, State of California is described as follows: The southeasterly 10.00 feet of the northwesterly 18.00 feet of that portion of what is commonly known as the "Ireland Tract" in the Rancho Santa Gertrudes as shown on map recorded in Book 1, Pages 156 to 158 inclusive of Patents in the office of the County Recorder of said County described as follows: Beginning at a point in the northeasterly line of Downey and Sanford 0 Bridge Road, 40.00 feet wide, said point being the most westerly v corner of the parcel of land conveyed to John Leary, et ux., and described in Deed recorded July 13, 1951, in Book 36749, Page 4, Official Records of said County; thence North 58 ° 40'07" West thereon 175.00 feet; thence North 31 East 170 feet along the centerline of that certain 50.00 foot wide strip of land more particularly described in Parcel C of Declaration of Establishment of Easements recorded January 29, 1952, as Parcel 550 in Book 38138, Pages 360 to 362 inclusive of Official Records of said County to the true point of beginning; thence continuing along said centerline, North 31 ° 06'45" East 100 feet; thence North 58 West 148.98 feet, more or less to the easterly line of the land described in Deed recorded in Book 146, Page 471 of Deeds, records of said County; thence along said easterly line South 21 ° 50'12" West 101.32 feet to a line that bears North 58 East 132.64 feet, to the true point of beginning. RESOLUTION NO. 5793 V -168 - PAGE 2 Reserving unto Southern California Edison Company, a corporation, an easement to construct, use, maintain, operate, alter, repair, replace or remove facilities for transmission of electric energy, communications and other related purposes, in, under, over and across the herein above described property. Also reserving unto GTE Corporation, an easement to construct, use, maintain, operate, alter, repair, replace or remove facilities for transmission of electric energy for communications and other related purposes, in, under, over and across the herein above described property. Also reserving unto American Cablesystems Company, a Corporation, an easement to construct, use, maintain, operate, alter, repair, replace or remove facilities for transmission of radio and /or television signals and other related purposes, in, under, over and across the herein above described land. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and shall cause a certified copy thereof, attested to by the City Clerk under the seal of the City of Downey, to be recorded in the office of the County Recorder of the County of Los Angeles.
