HomeMy WebLinkAboutResolution No. 5709 RESOLUTION NO. 5709 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOW NEY , CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING PROPOSED CITY CHARTER MEASURES AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a Special Municipal Election is to be held in the City of Downey, California on November 2, 1993, at which there will be submitted to the voters the following Charter amendments: Charter Amendment #6: Shall Section 515 of the City of Downey Charter be amended, as specifically set forth in the Proposed Revisions to the Charter of the City of Downey, to allow the City Council to determine whether a violation of a City Ordinance or the Downey Municipal Code shall constitute a misdemeanor or an infraction and be punishable as provided in the State Government Code for violations of Ordinances of General Law Cities? Charter Amendment #7: Shall Section 1307 be added to the Charter of the City of Downey, as specifically set forth in the proposed Revisions to the Charter of the City of Downey, to provide that the candidate's statement printed in the sample ballot as allowed by the Sta to Elections Code be limited to a sta tement of the candidate's own personal background and qualifications and shall not make reference to other candidates or to the other candidates' qualifications, character or activities? Charter Amendment #8: Sh a l l "The Downey Term Limitations and Ballot Access Act" be enacted which would amend the City of Downey Charter to limit service on the Downey City Council to two full terms, as defined? NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF DOW N EY , CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. With respect to Charter Amendment No. 6, the City Council hereby authorizes Council Member Gary P. McCaughan to file the written argument in favor, in accordance with provis ions and requirements set forth in Section 4 of this Resolution. SEC TI O "' 2. With respect to Charter Pmendment No. 7, the City Council hereby authorizes Council Member Diane P. Boggs to file the written argument in favor, in accordance with provisions and requirements set forth in Section 4 of this Resolution. SECTION 3. With respect to Charter Pmendment No. 8, the City Council hereby authorizes Council Member Robert S. Brazelton to file the written argument against, in accordance with provisions and requirements set forth in Section 4 of this Resolution. SECTION 4. All of the arguments referenced in Sections 1 -3 regarding the City measures shall be prepared and filed in accordance with Article 4, Chapter 3, Division 5 of the Elections Code of the State of Cali fo rn is and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measures may be submitted to the City Clerk. Resolution No. 5709 Page 2 SECTION 5. That the City Council directs the City Clerk to transmit a copy of the Charter measures to the City Attorney. The City Attorney shall prepare an impartial analysis of the Charter measures showing the effect of the measures on the existing law and the operation of the measures. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 6.
