HomeMy WebLinkAboutResolution No. 5556 RESOLUTION NO. 5556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING A MEASURE AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a Special Municipal Election is to be held in the City of Downey, California on November 3, 1992, at which there will be submitted to the voters the following measure: Shall Ordinance No. 944 be adopted, which approves the Utility Users Tax as a special tax and requires the money received from the Utility Users Tax to be (1) deposited into a special fund of the City; (2) accounted for separately from other taxes and revenue; and (3) used only for public safety services? NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Council, being the legislative body of the City of Downey, hereby authorizes Council Member Barbara J. Riley to prepare a written argument in favor of the measure; and Council Member Robert S. Brazelton to prepare a written argument in opposition to the measure, as members of said body as specified above in accordance with Article 4, Chapter 3, Division 5 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. SECTION 2. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 3. Resolution No. 5551, adopted on April 28, 1992, is hereby amended to provide that the language of the ballot measure specified in such Resolution shall be replaced with the following ballot measure and the City Clerk shall note this change on Resolution No. 5551: Shall Ordinance No. 944 be adopted, which approves the Utility Users Tax as a special tax and requires the money received from the Utility Users Tax to be (1) deposited into a special fund of the City; (2) accounted for separately from other taxes and revenue; and (3) used only for public safety services? Resolution No. 5556 Page 2 SECTION 4. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
