A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DOWNEY, GRANTING THE APPEAL AND
APPROVING TENTATIVE PARCEL MAP NO. 22194
FOR PROPERTY LOCATED AT 10935 LITTLE LAKE ROAD,
IN THE R1 -5,000 (SINGLE FAMILY RESIDENTIAL) ZONE
(OWNER /APPELLANT: LEE COOK)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. The City Council of the City of Downey does hereby find,
determine and declare that:
A. An Application ( "Application ") was filed by Lee Cook for a Tentative
Parcel Map to re- subdivide land of approximately 20,829 square feet into three
(3) single - family residential Tots in the R1 -5000 (Single - Family Residential) zone,
for the property located at 10935 Little Lake Road ( "Subject Property ").
B. The City Council held a duly noticed public hearing on March 26,
1991 and continued to April 9, April 23, May 28, and June 11, 1991,
concerning this resolution and fully and carefully considered all oral and written
testimony and all facts and opinions offered at the aforesaid public hearing prior
to adopting this resolution.
SECTION 2. Having considered all of the oral and written evidence
presented to it at said public hearings and in accordance to the State Subdivision Map
Act, the City Council finds, determines and declares that:
a) That the proposed subdivision which will result in the creation of three
(3) single - family Tots is consistent with the City's Comprehensive General
Plan land use designation for this property as Low - Density Residential
development.
b) That the design of the proposed subdivision is not inconsistent with any
specific plans because there are no specific plans controlling this area.
c) That the subject site is physically suitable for a three (3) lot single - family
residential development because the proposed subdivision meets current
minimum zoning requirements and General Plan Standards.
d) That the subject site is physically suitable for the proposed density of
development since the proposed three (3) lots meet the required
minimum development standards applicable to this area.

e) That the design of the proposed subdivision will not cause any
environmental impacts and has been found to be Categorically Exempt,
Class 5 under the California Environmental Quality Act (C.E.Q.A.).
F) That the design of the proposed subdivision will not cause any public
health problems because the proposed subdivision meets minimum
development standards for this area and has been found to be
Categorically Exempt under C.E.Q.A.
G) That this proposed subdivision will not interfere with any public
easements over this property.
SECTION 3. Based on the findings set forth above and the conditions
of approval, attached hereto as Exhibit "A ", the City Council of the City of Downey
hereby approves Tentative Parcel Map No. 22194.
SECTION 4. Pursuant to Government Code Section 65907 and Code of
Civil Procedure Section 1094.6, any action or proceeding to attach, review, set aside,
void or annul this decision, or concerning any of the proceedings, acts, or
determinations taken, done or made prior to such decision, or to determine the
reasonableness, legality or validity of any condition attached to this decision shall not
be maintained by any person unless the action or proceeding is commenced within
ninety (90) days of the date of this Resolution and the City Council is served within
one hundred twenty (120) days of the date of this Resolution. The City Clerk shall
send a certified copy of this Resolution to the Appellant at the address of said person
set forth in the record of the proceedings and such mailing shall constitute the notice
required by Code of Civil Procedure 1094.6.
ACTION 5. The City Clerk shall certify the adoption of this Resolution.

EXHIBIT "A"
Conditions of approval for Tentative Parcel Map No. 22194, The Planning Division
recommends the following conditions be required.
Planning
1. This approval is for the re- subdivision of approximately 20,829 square foot parcel into
three (3) parcels. Parcel one totals approximately 10,399 square feet, Parcel Two
totals approximately 5270 square feet, and Parcel Three totals approximately 5160
square feet, as shown on the revised Tentative Parcel Map No. 22194, dated February
1, 1991. Deviations or exceptions from said map shall not be permitted without
approval of the City Planning Commission.
2. The Planning Commission shall retain jurisdiction to amend or add conditions with
proper public notice or hearing to assure compatibility with the purpose and intent of
the Comprehensive Zoning Ordinance and to protect the public health, safety, and
general welfare.
3. All conditions of Tentative Parcel Map No. 22194 application shall be complied with
before said map becomes valid.
4. A Final Parcel Map shall be approved by the Planning Commission and the City Council
prior to issuance of a building permit.
5. Parking, driveway, and landscape areas shall be constructed and permanently
maintained in conformance with Sections 9150 and 9152 of the Downey Municipal
Code.
6. If the City approval is contingent on any changes to the plans submitted, the applicant
shall submit three (3) copies of revised plans, incorporating all approved amendments,
overlays, modifications, etc. to the Planning Division prior to the issuance of building
permits.
7. The applicant shall remove or modify any structures which violate the City's zoning
ordinance prior to Final Map approval.
8. If this subdivision falls within the 100 -year flood zone which will be determined in the
revised forthcoming Federal Emergency Management Agency (FEMA) map, the
applicant /developer shall meet the requirements for development as outlined under the
FEMA guideline for residential development.
Building and Safety
9. The applicant shall construct separate sewers for each lot to the standards of the City
Engineering and Building and Safety Divisions.

10. The applicant shall install all electrical and telephone utilities underground to the
standards of the Engineering and Building and Safety Divisions.
Engineering
11. The applicant shall construct a ten (10') foot wide minimum cement concrete driveway
approach on each parcel to the standards of the City's Engineering Division.
12. The applicant shall replace the existing curb depressions if not to be used for the new
development with curb and gutter to the standards of the City's Engineering Division.
13. Parkway trees shall be installed along the applicant's Little Lake Road street frontage;
and the applicant shall execute and record, with the L.A. County Recorder and a copy
filed with the Engineering Division, an agreement for the future installation of standard
width sidewalks along Little Lake Road, to the standards of the Engineering Division.
14. The applicant /developer shall submit an engineered grading and drainage plan for each
site for approval by the City's Engineering and Building and Safety Divisions prior to
the issuance of building permits, and all Tots shall drain to Little Lake Road and have
not less than 1% grade, and whenever the grade differential exceeds one (1) foot, a
retaining wall shall be required.
15. The standards of improvements, construction materials, and methods of construction
shall be accomplished in conformance with the standard plans and specifications as
outlined by the City of Downey.
16. All necessary drainage structures shall be approved by the City's Engineering Division.
17. The applicant shall provide sewer laterals to the front property line for each lot in this
subdivision.

19. The applicant shall install a six (6) inch water main extension and fire hydrant to the
standards of the City's Engineering Division, Fire Department, and Water Division.
20. The applicant shall provide hydrants of the single 2-1/2 inch and a single four (4) inch
separately gated outlet type at locations specified by the Engineering Division and
Department of Water and Fire.
