HomeMy WebLinkAboutResolution No. 5458 RESOLUTION NO. 5458 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS INTO THE LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON STREETS AND PUBLIC PLACES. (ANNEXATIONS 91/03 THROUGH 91/28). WHEREAS, the City Council by Resolution No. 5456, proposed to annex certain areas into Lighting Maintenance District A.D. 121 pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of the California Streets and Highways Code); and WHEREAS, by Resolution No. 5456 , the City Council ordered the Engineer to prepare a report pursuant to Article 2 of Chapter 1 of Part 2 of Division 15 of the California Streets and Highways Code; and WHEREAS, the Engineer did prepare and file such a report and the same was approved by the City Council on the 25th day of June, 1991, by Resolution No. 5457. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the annexation of certain areas into the Lighting Maintenance District A.D. 121, and to maintain and furnish electrical current to street lighting fixtures located on streets within the City of Downey as shown on Plan Nos. 1 -C, 2 -C,D, 3- B,C,D, 4 -C,E, 5 -B,D, 6- A,B,C,D, 7 -AA, A, E, 8 -D, 9 -C, 10 -C on file in the office of the City Clerk, in accordance with the report of the Engineer dated June 25, 1991, on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. These annexations, in the opinion of the City Council, are of more than ordinary benefit, and the Council hereby makes the costs of all expenses, work improvements, energy and maintenance chargeable upon the zone within the District benefited. The area within the District is that portion of the City of Downey shown on the above specified plans on file in the office of the City Clerk, on which the boundaries thereof are described by boundary line. Reference is hereby made to the plans for a complete and detailed description of the area. The plans on file shall govern for all details as to the extent of the assessments. SECTION 3. Any lots or parcels of land known as public property, which are included in the District, shall be exempt from assessment in accordance with Section 22663 of the California Streets and Highways Code. SECTION 4. The improvements contemplated shall be done under the provisions of Chapter 6 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22675 et seq). SECTION 5. Collection of the assessments caused by this Resolution shall be made pursuant to the method described by Article 2 of Chapter 4 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22645 et seq). Notice is hereby given that on July 23, 1991, at 7:30 p.m. in the Council Chambers of the City of Downey at 11111 Brookshire Avenue, Downey, California, all interested persons may appear before the City Council and be heard concerning annexation into the District and all other matters relating thereto. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the Hearing. Any such protest shall state all grounds of the objection and shall contain a description sufficient to identify the property. SECTION 7. The City Clerk shall cause notice of the Hearing to be given pursuant to Article 2 of Chapter 2 of Part 15 of the California Streets and Highways Code (Section 22588 et seq). SECTION 8. The City Clerk shall certify to the adoption of this Resolution.
