A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
COUNTY OF LOS ANGELES, STATE dF CALIFORNIA ADOPTING
GENERAL PLAN AMENDMENT NO. 89-1
AMENDING THE HOUSING ELEMENT OF THE GENERAL
PLAN AND APPROVING THE MITIGATED NEGATIVE DECLARATION
WHEREAS, The City of Downey has an adopted general plan which includes land
use, circulation, housing, open space, noise, safety and seismic safety elements
and a land use map; and
WHEREAS, Section 66300 et, seq~ of the California Government Code empowers
cities to prepare and amend general plans; and
WHEREAS, Section 66580 et, seq, of the California Government Code outlines
State policies and intentions, regional housing needs and element guidelines; and
WHEREAS, The City of Downey has prepared the revision to the housing element,
submitted the element of review to the State Office of Housing and Community
Development and considered comments; and
WHEREAS, on August 2, and continued to September 6, 20, 28, October 4,
November 1, and December 6, 1989, the Planning Commission of the City of Downey in
accordance with Section 65864 of the California Government Code conducted public
hearings, considered oral and written testimony; and
WHEREAS, the Planning Commission, in accordance with Sections 65354 and 65356
of the California Government Code is authorized to forward recommendations on
general plan amendments to the City Council; and
WHEREAS, the Planning Commission, at its regular meeting of December 6, I989
adopted Resolution Nu, 1307 recommendiny to the City Council adoption of the
Housing Element;
WHEREAS, a mitigated negative declaration has been prepared in accordance
with the California Environmental Quality Act and City of Downey Environmental
Guidelines; and
WHEREAS, on January 23, and continued to February 27, and March 13, 1990, the
City Council of the City of Downey, in accordance with Section 65090 of the
California Government Code conducted pub|ic hearings, considered oral and written
testimony"
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Downey as
follows:
Section 1. The City Council HEREBY FINDS AND DETERMINES that:
A. The revised housing element shall replace the existing housing element
for it presents more complete analysis and documentation of policies and
issues which are no longer applicable or not addressed in the current
plan, including assessment of existiny needs, vacant land and available
sites.

B. The revised general plan text provides improved policies and standards
for the provision of adequate and affordable housing.
C. The text is both internally consistent and consistent with other
applicable documents and the State of California General Plan Guidelines.
D. The text differs from the Southern California Association of Government's
(SCAG) Regional Housing Needs Assessment. SCAG predicts 1,705 units in
the next five year period. The element discusses constraints which limit
housing, including flood hazards, land costs and lack of vacant land.
The text further explains how SCAG's projection was skewed by the
artificial housing economy created by the housing replacement program for
the Century Freeway (I -105) and reliance on Long Beach statistics for
housing projections. Downey, located at the north of the Long Beach
statistical area, has historically produced less housing than Long
Beach. The element proposes 315 housing units over the next five year
period.
Section 2. An Initial Study of Environmental Impact and a Negative
Declaration have been prepared for General Plan No. 89 -1 in accordance with the
provisions of the California Environmental Quality Act (CEQA) and City of Downey
Environmenal Guidelines. Prior to approving General Plan Amendment No. 89 -1 the
City Council considered the Initial Study and Negative Declaration together with
any comments received during the public review process. On the basis of the
Intial Study and comments received, the City Council HEREBY FINDS, DEI and
DECLARES there is no substantial evidence the proposed General Plan Amendment No
89 -1 may have a significant adverse effect on the environment. The City Council
HEREBY ADOPTS the Negative Declaration for General Plan Amendment No. 89 -1.

Section 3. The City Council HEREBY Resolves that the Housing Element of the
General Plan is hereby amended by the adoption of General Plan Amendment 89 -1, a
comprehensive revision and update to the City's housing element of the general
plan, incorporating the attached text (Exhibit A).
