HomeMy WebLinkAboutResolution No. 5262 RESOLUTION NO. 5262 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING GENERAL PLAN AMENDMENT GP-89-3, AMENDING THE GENERAL PLAN OF THE CITY OF DOWNEY THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS: ~ Section 1. The City Council of the City of Downey hereby finds, determines and declares that: A. An application, GP-89-3, for a General Plan Amendment was filed with the City to change the land use designation of the property at 7339-45 Florence Avenue (Assessor Parcel No. 6359-29-22) from "General Commercial" to "Low Medium Density Residential". B. The City Planning Commission after reviewing the General Plan Amendment application, expanded its Study Area to include the neighboring property at 730I Florence Avenue (Assessor Parcel No. 6359-29-23) to allow for the full consideration of the land use issues that the proposed amendment preSented. Attached hereto as Exhibit "A" and incorporated herein by reference, is an area map showing the location of the properties at 7301 and 7339-45 Florence Avenue. C. A General Plan Report and General Plan Map were adopted by the City Council on January 8, 1973 by Resolution No, 2760, in conformance with the California Government Code. D. The General Plan is a long-range, comprehensive document which serves as a guide for the orderly development of the City of Downey. E. The General Plan by its very nature and purpose needs to be updated and ~~� refined in order to meet current and future community needs. F. The amendment proposes to change the land use designation of the properties at 7301 and 7339-45 Florence Avenue from "General Commercial" to "Low Medium Density Residential". G. The Planning Commission gave required notice and held public hearings on General Plan Amendment GP-89-3 on December 6, 1989 and January 3, 1990 for the purpose of considering proposed General Plan Amendment GP-89-3. H. Following said public hearings, the Planning Commission gave careful consideration to the testimony, the facts and opinions presented, and, by Resolution NV° 1318 recommended the Council amend the General Plan by adopting General Plan Amendment GP-89-3. I. The City Council has fully reviewed and carefully considered the Initial Study of Environmental Impacts and Negative Declaration prepared for this proposed amendment, including all information presented at the public hearings, in making its decision on the amendment to General Plan. The City Council gave required notice and held a public hearing on General Plan Amendment GP -89 -3, at which the proposed amendment and General Plan Map were displayed and explained. K. The proposed General Plan Amendment would create a coordinated and balanced land use pattern capable of effectively meeting the present and future needs and desires of the community in a manner providing for appropriate land use benefits and compatibility. Section 2. The City Council of the City of Downey further finds, determines and declares that an Initial Study of Environmental Impacts and Negative Declaration have been prepared for General Plan Amendment GP -89 -3, in accordance with the provisions of the California Environmental Quality Act (CEQA), State CEQA Guidelines and the City of Downey's Revised Environmental Procedures. Prior to approving the proposed General Plan Amendment, the City Council considered its Initial Study and Negative Declaration, together with comments received during the environmental assessment's public review period. Based on the Initial Study and submitted comments, the City Council hereby determines and declares there is no substantial evidence the proposed General Plan amendment will have a significant adverse effect on the environment. Therefore, the City Council hereby adopts the Negative Declaration for General Plan Amendment GP -89 -3. Section 3. NOW THEREFORE, BE IT DETERMINED, the City Council of the City of Downey resolves that the Land Use Element of the General Plan is hereby changed by the adoption of General Plan Amendment GP -89 -3, changing that certain real property shown and described on Exhibit "A" from "General Commercial" to "Low Medium Density Residential ". Section 4. The City Clerk shall certify the adoption of this Resolution. APPROVED AND ADOPTED this 13th day of February , 1990. Randall .
