HomeMy WebLinkAboutResolution No. 5236 RESOLUTION NO. 5236 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT AN UNDERGROUND UTILITY DISTRICT BE ANIErTDED PURSUANT TO RESOLUTION NO. 5231 (DISTRICT NO. 16 - FLORENCE AVENUE) pursuant to Resolution No. 5231, a public hearing was held WHEREAS, p on December 12, 1989, by the City Council of the City of Downey; and WHEREAS, notice of such hearing was given in the manner required -- by law; and WHEREAS, such hearing has been duly held, and all persons interested were given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it hereby finds and determines that the public necessity, safety and welfare require that Underground Utility District No. 16 be amended to include a utility line running northerly from Florence Avenue at a point that is located 257 feet southeasterly from the southeasterly line of Tweedy Lane as shown on Amended Plan No. 3 33 - 23. The Amended Underground Utility District No. 16 is further described by the Amended boundary description on file in the office of the City Clerk along with Plan No. 3 33 - 23, both of which are made a part of this Resolution by this reference. SECTION 2. Those poles, overhead wire and associated structures on Florence Avenue as shown on Plan No. 3 - 33 - 23 shall be removed and underground installations made within the right -of - way and up to 100 feet outside of the right -of - way in said Underground Utility District not later than December 31, 1991; provided, however, utility companies upon showing that they cannot comply with such limitations may, upon approval of the City Council, have an extension of time as provided in Section 7510 of the Downey Municipal Code. In order to provide adequate time for the utility companies to convert their overhead service connections to private properties not voluntarily converted, all private property improvements required by this District to be installed by the property shall be completed not later than June 30, 1991. SECTION 3. Within ten (10) days after adoption of this Resolution, the City shall mail a copy of the same and a copy of Chapter 5, Article VII, of the Downey Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. 1 SECTION 4.
