RESOLUTION NO. 5231
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO AMEND THE UNDERGROUND
UTILITY DISTRICT ALONG FLORENCE AVENUE BETWEEN LAKEWOOD
BOULEVARD AND TWEEDY LANE TO INCLUDE ADDITIONAL
SPECIFIED UTILITIES TO BE RELOCATED UNDERGROUND.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES
AS FOLLOWS:
SECTION 1. That it is the intention of the City Council of the
City of Downey to promote the public interest and convenience by amending
Underground Utility District No. 16 to include additional electrical and /or
communication facilities into the District. This amendment will require
the removal of poles with their related overhead wires and associated
overhead structures located northerly from Florence Avenue between Tweedy
Lane and Lakewood Boulevard in the District in accordance with the provisions
of Chapter 5, Article VII of the Downey Municipal Code.
SECTION 2. The Underground Utility District boundary and poles
to be removed shall be as shown on Plan No. 3 - 33 - 23 on file in the office
of the City Clerk; and by this reference both the plan and description
are made a part hereof.
SECTION 3. All work contemplated by the Resolution of Intention
shall be done in accordance with the provisions of Chapter 5, containing
Sections 7500 through 7510 of Article VII, of the Downey Municipal Code.
All improvements within the public right -of - way and on private property
within 6 feet of the public right -of - way shall be completed by December
31, 1991, and cost thereof shall be paid for by the utility companies;
and all other work on private property shall be completed by the property
owners by June 30, 1991. If said work is not completed by June 30, 1991,
the City shall proceed with the completion of said work or removal of service
pursuant to the provisions of Section 7508.
SECTION L. Pursuant to the provisions of Section 7501 of the Downey
Municipal Code, the City Council of the City of Downey hereby sets the
hour of 7:30 p.m., on December 12, 1989, as the time, and the Council
Chambers at 11111 Brookshire Avenue, Downey, California, as the place for
the hearing of protests in relation to the proposed amendment to the
district.
SECTION 5. The City Clerk shall give notice of said hearing in
the manner provided in Section 7501 of the Downey Municipal Code.
