HomeMy WebLinkAboutResolution No. 5157 RESOLUTION NO. 5157 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, DENYING TENTATIVE PARCEL MAP No. 20657 FOR PROPERTY LOCATED AT 13019 CORNUTA AVENUE Section 1. The City Council does hereby find and determine that a written request was filed by Councilmember Diane Boggs, with respect to the real property described as follows: 13019 Cornuta Avenue, appealing the actions of the Planning Commission on Tentative Parcel Map No. 20657, that a public hearing was duly set for March 14, 1989 at 7 :30 p.m. in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, and a notice of the date, time, place and purpose of the aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Studies and investigation made by the City Council and in its behalf reveal the following facts: 1. Denial of Tentative Parcel Map No'. 20657 is pursuant to Section 66474 of the Subdivision Map Act. The Map Act specifies that the City Council shall deny a parcel map if any of seven findings of fact support denial. The following facts support the denial: (a) In accordance with Section 66474 (b), the design or improvement of the proposed subdivision is not consistent with the City's General Plan principles and guidelines since the proposed density and lotting pattern is incompatible with the surrounding neighborhood; (b) In accordance with Section 66474 (c), the site is not physically suitable for the type of development since the development of the subject lots fronting towards the frontage road is inconsistent with the existing lotting pattern of the neighborhood. (c) In accordance with Section 66474 (d), the site is not physically suitable for the proposed density of development since the proposed 5,525 square foot lots are incompatible with the existing 7,200 square foot lots of the surrounding neighborhood; and Section 2. Having considered all oral testimony and written documents presented at the public hearing and based upon the findings and facts set forth in Section 1 of this Resolution, the City Council of the City of Downey hereby approves the appeal and hereby denies Tentative Parcel Map No. 20657. Section 3. The City Council further finds and determines that Tentative Parcel Map No. 20657 was filed and reviewed in accordance with Section 9200 of the Downey Municipal Code. Pursuant to the provisions of California Code of Civil Procedure Section 1094.6 as adopted by the City of Downey City Council by Resolution No. 5157 , judicial review of the City Council's decision regarding this matter may be made purusant to Section 1094.5 of the California Code of Civil Procedure provided that a petition is filed no later than the ninetieth (90th) day following the date of this resolution. The City Clerk shall send a certified copy of this resolution to the Applicant and the Appellants at the addresses contained in the record, which mailing shall constitute notice to them of the City Council's decision. Section 5. The City Clerk shall certify the adoption of this resolution. PASSED, APPROVED, AND ADOPTED this 23i• ta jo May 9.
