HomeMy WebLinkAboutResolution No. 4997 RESOLUTION NO. 4997 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT AN UNDERGROUND UTILITY DISTRICT BE FORMED PURSUANT TO RESOLUTION NO. 4987 (DISTRICT NO. 14 - NANCE STREET). WHEREAS, pursuant to Resolution No. 4987, a public hearing was held on May 24, 1988, by the City Council of the City of Downey; and WHEREAS, notice of such hearing was given in the manner required by law and; WHEREAS, such hearing has been duly held, and all persons interested were given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it hereby finds and determines that the public necessity, safety and welfare require the removal of poles, overhead wires and associated structures and underground installation of wires and facilities for supplying electrical, communication, or similar or associated service in the City of Downey along Nance Street between Myrtle Street and Downey Avenue as shown on Plan No. 3- 25 -15. The area within Underground District No. 14 is further described by boundary description filed in the office of the City Clerk along with Plan No. 3- 25 -15, both of which by this reference are made a part hereof. SECTION 2. Those poles, overhead wires and associated structures on Nance Street as shown on Plan No. 3 - 25 - 15 shall be removed and underground installations made within the right -of -way and up to 100 feet without the right -of -way in said Underground Utility District not later than July 1, 1990; provided, however, utility companies upon showing that they cannot comply with such limitations may, upon approval of the City Council, have an extension of time as provided in Section 7510 of the Downey Municipal Code. In order to provide adequate time for the utility companies to convert their overhead service connections to private properties not voluntarily converted, all private property improvements required by this District to be installed by the property shall be completed not later than January 1, 1990. SECTION 3. Within ten (10) days after adoption of this Resolution, the City shall mail a copy of the same and a copy of Chapter 5, Article VII, of the Downey Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED THIS 24 day of May , 1988. z r • / 2 Diane P.
