HomeMy WebLinkAboutResolution No. 4989 RESOLUTION NO. 4989 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AGREEMENT FOR INSTALLATION AND MAINTENANCE OF SIGNS AND PAVEMENT MARKINGS ON TELEGRAPH ROAD AT STOAKES AVENUE WITHIN THE CITY OF DOWNEY WHEREAS, Downey and Pico Rivera have determined that there is a public health and safety problem in that left turn movements from, Telegraph Road onto Stoakes Avenue during evening peak hours are not restricted; WHEREAS, a traffic engineering study has been performed by the City of Downey which indicates that the vehicular traffic safety can be improved by establishment of a left -turn restriction for westbound Telegraph Road to southbound Stoakes Avenue and in concurrence with the City of Pico Rivera, and WHEREAS, Downey and Pico Rivera desire to provide for the installation of certain signs and pavement markings to create left turn restrictions at Telegraph Road onto Stoakes Avenue, to arrange for the particular installation, maintenance, and costs of such left turn restrictions, and WHEREAS, the centerline of Telegraph Road is the common boundary between Downey and Pico Rivera necessitating an agreement between Downey and Pico Rivera prior to the implementation of left turn restrictions; NOW, THEREFORE, it is mutually resolved as follows: SECTION 1. Downey shall provide, install and maintain the following signs and pavement markings on Telegraph Road at Stoakes Avenue: (a) R -34 -2 sign - "NO LEFT TURN OR U- TURN" - 3:00 to 6:00 p.m. "; f (b) State Type "N" Reflector Sign; (c) Eight inch (8 ") White Barrier Pavement Markings. 1 The signs and pavement markings to be installed in the manner as described in the map attached hereto and incorporated herein by reference as "Appendix A" SECTION 2. Downey shall maintain the signs and pavement markings described in Paragraph 1 at the level of service equal to that which Downey performs for signs and pavement markings on streets and highways dedicated to public use within the City of Downey. SECTION 3. Pico Rivera shall cooperate with Downey in that it shall allow Downey to provide, install and maintain the signs and pavement markings as provided for in this Agreement. SECTION 4. Each party shall defend, indemnify and hold the other harmless from any claims for personal injury (including death) or property damage arising out of the indemnifying party's acts or omissions with respect to its obligations under this Agreement. SECTION 5. This Agreement shall supersede all prior Downey -Pico Rivera agreements regarding signs and markings at Telegraph Road at Stoakes Avenue. SECTION 6. This Agreement shall be effective upon execution by both 1 parties and may be terminated upon 30 day's written notice by either party. APPROVED AND ADOPTED THIS 26th day of April , 1988.
