A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY DENYING A PERMIT TO AM /PM TAXI TO
CONDUCT TAXI SERVICE WITHIN THE CITY OF DOWNEY
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds that:
A. AM /PM Taxi has applied to the City for a
permit to operate a taxi service within the City of Downey
pursuant to the provisions of Downey Municipal Code
Section 5010, et seq.
B. In accordance with the requirements of Downey
Municipal Code Section 6533.2, the Police Department has
conducted a full investigation of the application.
C. On February 9, 1988, the City Council held a
duly- noticed public hearing on the application at which time
it received testimony from the Police Chief, two
representatives of the applicant, and other interested
parties, as well as receiving written evidence from such
persons. The City Council continued said hearing to
-- February 23, 1988, at which time the City Council again
received testimony from the Police Chief, applicant and
other interested persons, as well as receiving written
evidence from them.
D. The City Council has carefully reviewed all of
the testimony and written materials received prior to making
a decision on the application.
SECTION 2. The City Council of the City of Downey
hereby denies the application of AM /PM Taxi to operate
taxicab service within the City of Downey based upon the
following findings pursuant to Downey Municipal Code
Section 6533.2:
A. Applicant has not complied with the terms and
conditions of Downey Municipal Code Sections 6510, et seq.,
pertaining to taxicab operations in that the Police
Department cited applicant for operating taxicabs within the
City without proper licenses, and applicant has admitted to
operating taxicabs within the City on numerous other
occasions without proper licenses. Additionally, a majority
of the applicant's drivers are either not properly licensed
to drive taxicabs or have serious problems with their
driving records. These problems are serious problems in the
management of the applicant's company which cannot be
ignored.
B. The public convenience and necessity do not
require the permit to be granted in that the City of Downey
is adequately served by the existing taxicab permittee and
the City's own transportation system. Thus, no need exists
for an additional taxi permittee.
C. The proposed operations of the applicant are
not desirable for the City based upon the specific findings
described in subparagraphs A and B of this section.
SECTION 3. The City Clerk shall certify to the
adoption of this Resolution.
