HomeMy WebLinkAboutResolution No. 4971 RESOLUTION NO. 4971 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 88/01 - LAURELDALE AVENUE BETWEEN GOLDEN STREET AND PRICHARD STREET) AND DEMPSTER AVENUE BETWEEN GOLDEN STREET AND PRICHARD STREET. WHEREAS, the City Council of the City of Downey on January 12, 1988, adopted Resolution No. 4963 declaring its intention to order certain improvements; and " WHEREAS, on January 12, 1988, the City Council by Resolution No. 4963, set Tuesday, February 9, 1988, at 7:30 p.m. in the Council Chambers of the City Hall at 11111 Brookshire Avenue, Downey, California, as the time and place for hearing protests to the proposed improvements; and WHEREAS, on February 1 88 a t the time and place specified, a public hearing Y 9, 9 � P P � P g was held in accordance with Resolution No. 4963, notice having been given in the manner required by law; and WHEREAS, at the hearing the City Council did pass upon all written and oral protests made in reference to the improvements. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of that area to be annexed to Lighting Maintenance District A.D. 121 are described on Plan No. 88/01 and boundary description on file in the office of the City Clerk and by this reference made a part hereof. SECTION 2. The improvements consist of the installation of street lighting standards and furnishing of maintenance and energy for those street lights described in the report of the Engineer dated January 12, 1988, as approved by the City Council. SECTION 3. The entire estimated cost of the improvements shall be borne by the District and shall be paid by special assessment charged against all the lands and improvements within said area for the period beginning July 1, 1988. SECTION 4. The improvements described in Resolution No. 4961 and the report of the Engineer, submitted pursuant to said Resolution No. 4961 and approved by Resolution No. 4962, shall be made in the manner and at the time prescribed by law. SECTION 5. The City Council finds that the Southern California Edison Company, subject to the jurisdiction of the Public Utilities Commission of the State of California, is the only contractor practically capable of serving the street lighting improvements Y P Y P g g P in the manner provided for and as described herein. It is, therefore, ordered that the improvements of the Lighting District be carried out by the Southern California Edison Company in accordance with the Plans and Specifications. SECTION 6. The Mayor is authorized and directed to execute the contract with the Southern California Edison Company for the improvements in accordance with the Plans and Specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution and shall cause a copy of this Resolution to be published once in the designated newspaper.
