HomeMy WebLinkAboutResolution No. 4940 RESOLUTION NO. 4940 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A LOCAL APPEALS BOARD TO CONSIDER APPEALS AS TO ACCESS TO PUBLIC ACCOMMODATIONS BY PHYSICALLY HANDICAPPED PERSONS WHEREAS, State law in Health and Safety Code Sections 19955 through 19959 has established rules and regulations to insure that public accommodations or facilities constructed in this state with private funds provide for accommo- dation to the needs of physically handicapped persons; and WHEREAS, Section 19957.5 of the Health and Safety Code provides that the City may appoint a local appeals board composed of five members to hear written appeals brought by any person regarding action taken by the Building and Safety Division of the City in enforcement of the requirements of State law related to accommodations for physically handicapped persons; NOW, THEREFORE, the City Council of the City of Downey does resolve, declare, determine, and order as follows: SECTION 1. There is hereby created a Local Appeals Board for Handicapped Accommodations. The Board shall consist of five members who shall be appointed by and hold office at the pleasure of the Council. The members of the Board shall consist of the following categories: Two (2) members of the Board shall be physically handicapped persons; two (2) members shall be persons experienced in construction; and one (1) member shall be a public member. The Building Official shall act as Secretary of the Board but shall not be a voting member, and shall keep a record of all proceedings and notify all persons concerned of the findings, determinations, and decisions of the Board. SECTION 2. The members of the Board shall hold office for the term of four (4) years from the date of their appointment and qualification and shall serve without compensation. SECTION 3. The application fee for hearings before the Board will be one hundred and fifty (150) dollars. SECTION 4. This resolution shall take effect immediately. SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of original res- olutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted.
