HomeMy WebLinkAboutResolution No. 4917 RESOLUTION NO. 4917 A RESOLUTION CF THE CITY CCUNCIL OF THE CITY or DAY GRANTING PAVE CIMDITIO AL USE PERMIT 87 -1 THE CITY CODICIL or ME CITY OF CCWIEY DONS RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine that an application was duly filed by the Assistance League of Downey with respect to the real property described as follows: 7749 Florence Avenues requesting a Permissive Conditional Use Permit to use property for meetings and related functicns for a philanthropic organization in the PS (Parking Buffer), R3 (Medium Density Multiple Family Residential) and R1 -5000 (Single Family Residential) zones; that a public hearing was duly set for August 25, 1987 7:30 p.m., in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, and a notice of the date, time, place and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Studies and investigation made by the Council and in its behalf reveal the following facts: 1. That the requested Permissive Conditional Use Permit will not adversely affect the purpose and intent of the Downey Mmicipal Code oc the City's General Plan ac the public convenience cc general welfare of persons residing cc Marking in the neighbor- hood because the request is consistent with the Downey Municipal Code and the General Plan. 2. That the requested uses will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because conditions are required which will mitigate any potential *petits on surrounding properties. 3. That the size and shape of the sits proposed far the use is adequate to all the full developent of the proposed use in a manner not detrimental to the particular area because space is available for improvements to the property which will provide required parking and ingress and egress for the property. _ 4. That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways in the area because the parking facility for the project is accessed from Florence Avenue, designated as a Majcc Highway on the blaster Plan of Streets and Highways, and a signalized intersection is proposed at Florence Avenue and Rives Avenue to facilitate traffic moats. 5. A Negative Declaration has been prepared for the project according to the California Environmental Quality Act (C.E.Q.A.) SECTION 2. The City Council further finds and determines that facts to exist as required in Section 9166.12 of the Downey nalicipel Code justifying the granting of a Permissive Conditional Use Permit. SECTION 3. Based upon the aforementioned findings, the Council hereby grants with refit to the property described in Section 1, above, a Permissive Conditional Use Permitsubject to the following conditions: Resolution No. 4917 PCUP 87 -1 page 2. PLANNING 1. This approval is for a Permissive Conditional Use Permit to use the property located at 7749 Florence Avenue for meetings and related functions of a philanthropic organization, the Assistance League of Downey, as shown on the revised site plan dated May 28, 1987. The hours of operation for this use shall be between 7:00 a.m. and 12:30 a.m.' Deviations or exceptions from said plot plan shall not be permitted without the approval of the City Planning Commission. 2. The Planning Commission shall retain jurisdiction to amend or add conditions without further public notice cc hearing to assure compatibility with the purpose and intent of the Comprehensive Zoning Ordinance and to protect the public health, safety, and general welfare. 3. All conditions of Permissive Conditional Use Permit 87 -1 shall be completed before this approval beads valid. 4. Parking, landscaping and signing shall meet City Cods requirements and shall be reviewed by the Design Review Board and approved prior to the issuance of a Certificate of Occupancy. 5. The Dinsdale Street vehicular entrance and gate shall be locked and used for emergency vehicles only. A personnel gate is permitted for access to the area between the wall and Dinsdale Street for purposes of maintenance. ENGINEERING 6. The signal at Rives Avenue and Florence Avenue shall be modified to facilitate vehicular ingress and egress to the project, subject to the standards of the City Engineering Division. 7. Construction of ascent concrete commercial driveway approach an Florence Avenue shall be established to the standards of the City Engineering Division. 8. Standard width sidewalk and parkway tree shall be installed along Florence Avenue. Said improvements nt s shell be petsrrently maintained to the standards of the Department of Public Works and the City Engineering Division. 10. An engineered grading and drainage plan for the site shall be submitted by the developers for approval by the City Engineering and Building and Safety Divisions, and the site shall drain to Florence Avenue and have not less than a 1% grads, and whenever the grade differential exceeds one foot, a retaining well shill be required. 11. The standards of improvement, construction arterials, and methods of construction shall be accomplished in conformance with the standard plans and specifications. 12. All necessary drainage structures shall be approved by the City Engineering Divisicn. Resolution No. 4817 PCUP 87 -1 page 3. mom 4.
