HomeMy WebLinkAboutResolution No. 4860 RESOLUTION NO. 4860 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ESTABLISH AN UNDERGROUND UTILITY DIS'1'RICT ALONG THE ALLEY EAST OF DOWNEY AVENUE AND BETWEEN FIRESTONE BOULEVARD AND SECOND STREET AND CAUSING ALL SPECIFIED UTILITIES THEREIN TO BE RELOCATED UNDERGROUND (DISTRICT NO. 13) THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the public interest and convenience require, and that it is the intention of the City Council of the City of Downey to establish an Underground Utility District and to order the removal of poles with their related overhead wires and assorted overhead structures along the alley east of Downey Avenue and between Firestone Boulevard and Second Street, all in accordance with the provisions of Chapter 5, Article VII, of the Downey Municipal Code. SECTION 2. The Underground Utility District boundary and poles to be removed shall be shown on Plan No. 3- 25 -14 on file in the office of the City Clerk; and by this reference both the plan and description are made a part hereof. SECTION 3. All work contemplated by the Resolution of Intention shall be done in accordance with the provisions of Chapter 5, containing Sections 7500 through 7510 of Article VII, of the Downey Municipal Code. All improvements within the public right -of -way and on private property within 100 feet of the public right -of -way shall be completed by March 31, 1988, and cost thereof shall be paid for by the utility companies; and all other work on private property shall be completed by the property owner by June 30, 1988. If said work is not completed by June 30, 1988, the City shall proceed with the completion of said work pursuant to the provisions of Section 7508. SECTION 4. Pursuant to the provisions of Section 7501 of the Downey Municipal Code, the City Council of the City of Downey hereby sets the hour of 7:30 p.m., on May 26, 1987, as the time, and the Council Chambers at 11111 Brookshire Avenue, Downey, California, as the place for the hearing of protests in relation to the proposed district. SECTION 5. The City Clerk shall give notice of said hearing in the manner provided in section 7501 of the Downey Municipal Code. APPROVED AND ADOPTED THIS 28 day of April 1 9 8 7.
