A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DENYING A REQUESTED ZONE CHANGE TO AMEND THE CITY'S
OFFICIAL ZONING MAP ADOPTED BY SECTION 9106.06 OF THE
DOWNEY MUNICIPAL CODE
(ZONE CHANGE CASE #235)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES ORDAIN AS FOLLOWS:
Section 1. That the Official Zoning Map of the City of Downey is not amended
from C -P (Professional Office) to C -2 (General Commercial) for property
described as follows:
8635 Florence Avenue
Assessor's Parcel No. 6360-012-010
Section 2. That the City Council finds that the following circumstances apply
to the above described property:
1. That the requested Zone Change is not consistent with the standards
which will encoruage harmonious development in the community, that its
approval is unnecessary and undesirable for the development of the
City, and further that it is not in harmony with the objectives of the
City's General Plan nor will it foster the public health, safety, and
general welfare of the City.
2. That the requested Zone Change will not be compatible with the
surrounding land uses because the potential noise, traffic, and trash
which such uses can generate would impact the nearby single family
residences.
3. That the use of this site for General Commercial land uses would
require parking lot modification which would have to be limited due to
the size of the site and its configuration.
4. That the use of Tristan Drive for access to the needed parking lot
would result in an intrusion of too high a volume of non- residential
vehicle traffic on a local residential street. Tristan Drive is
designated in the City's circulation element of the General Plan as a
local street which consequently should not be used to provide access
to a commercial parking lot due to its close proximity to single
family residential land uses. The proposed rezoning would not
encourage or protect the character of this residential neighborhood.
5. That no conditions have changed since this property was last rezoned
that have significantly altered the circumstance which would warrant a
different zoning for the subject site
6. That based on the lack of conformity of this project with the City's
General Plan and the streets and highway plan for Downey, this Zone
Change amendment as requested would not be consistent with the City's
General Plan.
7. That the environmental impact of the proposed Zone Change has been
reviewed and has been determined to have a negative impact on the
environment in compliance with the California Environmental Quality
Act (C.E.Q.A.) and the City's Guidelines and a Negative Declaration
was published on November 20, 1986.
SECTION 3. Pursuant to the provisions of the California Code of Civil
Procedure, Section 1094.6 as adopted by the City of Downey City Council by
Resolution No. 3409, judicial review of the City Council's decisions regarding
this matter may be had pursuant to Section 1094.5 of the California Code of
Civil Procedure provided a petition is filed no later than the 90th day
following the date on which this decision became final.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution
and shall transmit a copy to the Applicant, Building and Safety Division, and
City Planning Division.
