HomeMy WebLinkAboutResolution No. 4772 RESOLUTION NO. 4772 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, DENYING PERMISSIVE CONDTIONAL USE PERMIT #4 The City Council of the City of Downey does resolve as follows: SECTION 1. The City Council does hereby find and determine that an application was duly filed by Quang Diep on behalf of the Department of Water and Power and Gilbert N. Campbell, with respect to the real property described as follows: 10403 Sherry Avenue and a vacant lot behind 7214 Florence Avenue; requesting a Permissive Conditional Use Permit to operate a commercial farm for the purpose of raising produce for sale off -site in the R1 -7500 (Single Family Residential) zone; that a public hearing was duly set for June 10, 1986 at 7:30 p.m. in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, and a notice of the date, time, place, and purpose of aforesaid hearing was duly given; that a hearing was duly held at the aforementioned time and place. Studies and investigation made by the Council and in its behalf reveal the following facts: 1. The requested Permissive Conditional Use Permit will adversely affect the public convenience and general welfare of persons residing in the neighborhood thereof by the use of chemicals (insecticide spray) and by the generation of dust. 2. The requested use will adversely affect the adjoining land uses because farming activities are incompatible with residential land uses. 3. The size and shape of the site proposed for the use is inadequate to allow the full development of the farming activities without creating a detrimental effect on the residential uses because the property is too narrow to provide adequate separation of the farming activities from the residential uses. 4. That the environmental impact of the proposed project has been reviewed and a Negative Declaration was prepared according to the California Environmental Quality Act (C.E.Q.A.) SECTION 2. The City Council further finds and determines that facts do not exist as required in Section 9166.12 of the Downey Municipal Code justifying the granting of a Permissive Conditional Use Permit. SECTION 3. Based upon the aforementioned findings, the Council hereby denies with respect to the property described in Section 1, above, a Permissive Conditional Use Permit. SECTION 4. The City Clerk shall certify to the adoption of this Resolution and shall transmit a copy to the Applicant, Planning Division, Building and Safety Division, and City Engineering Division.
