A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING A LETTER OF AGREEMENT BETWEEN THE CITY OF
DOWNEY AND THE DOWNEY PUBLIC SAFETY AUXILIARY UNIT.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The Letter of Agreement between the City of Downey and the
Downey Public Safety Auxiliary Unit, attached hereto and by this reference
incorporated herein, is hereby adopted.
SECTION 2. The City Clerk shall certify to the adoption of this
resolution and provide for the appropriate distribution thereof.

LETTER OF AGREEMENT
BETWEEN THE
DOWNEY PUBLIC SAFETY AUXILIARY UNIT
AND
CITY OF DOWNEY
In accordance with Federal law, the Fair Labor Standards Act (FLSA)
regulations will be implemented by April 15, 1986. As a result, Article IV,
Section 2, of the existing Memorandum of Understanding will become
inoperative. It is agreed that:
• In compliance with the FLSA regulations, paychecks will no longer be
averaged. Instead, Fire Department Communications Operators will be
paid for all hours actually accrued during the pay period.
• All hours worked in excess of forty (40) hours in a work week will be
paid at the overtime rate of time and one -half.
• To avoid the prospect of having to reduce the number of hours reported
for retirement purposes, the City will continue to report 40 hours per
week to PERS regardless of whether the employee actually accrued 40
hours during the week. However, for the purpose of calculating
overtime compensation, sick leave hours used will not be included as
part of the 40 -hour work week. Other forms of paid leave time (i.e.,
vacation and compensatory time) will be included as part of the 40 -hour
work week for purposes of calculating overtime compensation. -
This agreement has been reached for the purpose of maintaining both the
existing shift schedule as well as maintaining the number of hours reported to
the retirement system.
