HomeMy WebLinkAboutResolution No. 4695 • RESOLUTION NO. 4695 • �• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS 4 "INTENTION TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES (ANNEXATION 86/02 - VERDURA AVENUE BETWEEN GARDENDALE STREET AND GOLDEN AVENUE.) WHEREAS, the City Council by Resolution No. 4693 , proposed to annex a certain area into the Lighting Maintenance District A.D. 121 pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2 of Division 15 of the California Streets and Highways Code); and WHEREAS, by said Resolution No. 4693 , the City Council ordered the Engineer to prepare a report pursuant to Article 2 of Chapter 1 of Part 2 of Division 15 of the California Streets and tighways Code; and WHEREAS, the Engineer did prepare and file such a report and same was approved by the City Council on the llth day of February, 1986, by Resolution No. 4694. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the annexation of a certain area into the Lichting Maintenance District A.D. 121, and to maintain and furnish electrical current to street li:hting fixtures located on Verdura Avenue between Gardendale Street and Golden Avenue in the Cl.ty of Downey as shown on Plan No. SL -86/02 on file in the office of the City Clerk in accordance with the report of the Engineer dated February 11, 1986, on file in the office of the City Clerk and which by his reference is made a part hereof. SECTION 2. This annexation, in the opinion of the City Council, is of more than ordinary benefit, and the Council hereby makes the costs of all expenses, work improvements, energy and maintenance chargeable upon the zone within the District benefited. The area within the District is that portion of the City of Downey shown on the above specified plan on file in the office of the City Clerk, on which the boundaries thereof are described by boundary line. Reference is hereby made to the plan for a complete and detailed description of the area. The Plan on file shall govern for all details as to the extent of the easement. SECTION 3. Any lots or parcels of land known as public property, which are included in the District, shall be exempt from assessment in accordance with Section 22663 of the California Streets and Highways Code. SECTION 4. The improvements contemplated shall be done under the provisions of Chapter 6 of art 2 of Division 15 of the California Streets and Highways Code (Section 22675 et seq). SECTION 5. Collection of assessments caused by this Resolution shall be made pursuant to the method described by Article 2 of Chapter 4 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22645 et seq). SECTION 6. Notice is hereby given that on March 11, 1986, at 7:30 P.M., in the Council Chambers of the City of Downey at 11111 Brookshire Avenue, Downey, California, all interested persons may appear before the City Council and be heard concerning annexation into the District and all other matters relating thereto. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of the objection and shall contain a description sufficient to identify the property. SECTION 7. The City Clerk shall cause notice of the hearing to be given pursuant to Article 2 of Chapter 2 of Part 2 of Division 15 of the California Streets and Highways Code (Section 22250 et seq) . SECTION 8. The City Clerk shall certify to the adoption of this Resolution.
