HomeMy WebLinkAboutResolution No. 4655 RESOLUTION NO. 4655 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE NEW STREET BETWEEN FIRESTONE BOULEVARD AND SECOND STREET AND SECOND STREET BETWEEN NEW STREET AND DOWNEY AVENUE. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey, upon recommendation of the Planning Commission, declares its intention to vacate New Street 60.00 feet wide from a line that is parallel with and northeasterly 60.00 feet from the centerline of Firestone Boulevard 100.00 feet wide to the southwesterly line of Second Street 60.00 feet wide and Second Street 60.00 feet wide from the southeasterly line of said New Street to the northwesterly line of Downey Avenue 84.00 feet wide as shown on the attached copy of the map on file in the office of the City Clerk to which reference is made for further particulars. The public right -of -way bein g vacated is described as follows: PARCEL 1 The southeasterly 30.00 feet of lots known as 7 and 8 and the northwesterly 30.00 feet of lots known as 9 and 10 in Block 9 of the tract of the Downey Land Association in the City of Downey, County of Los Angeles, State of California as per map recorded in Book 2, Page 434 of Miscellaneous Records in the Office of the County Recorder of said County. EXCEPT: The southwesterly 10.00 feet of the southeasterly 30.00 feet of said Lot 8 and the southwesterly 10.00 feet of the northwesterly 30.00 feet of said Lot 10. RESERVING unto the City of Downey, a Municipal Corporation, an easement to construct, use, maintain, operate, repair, replace or remove facilities for water lines, fire hydrants, sewers, manholes or other purposes in, under, and across said 60.00 -foot wide herein -above described Parcel 1. ALSO RESERVING unto Southern California Edison Company, a Corporation, an easement to construct, use, maintain, operate, alter, repair, replace, or remove facilities for transmission of electric energy, communications, and under, over, other purposes in, , and across said 60.00 P P � foot -wide hereinabove described Parcel 1. ALSO RESERVING unto General Telephone Company of California, a Corporation an easement to construct, use, maintain, operate, alter, repair, replace or remove facilities for transmission of electric energy for communication and other purposes in, under, over, and across said 60.00 foot -wide hereinabove described in Parcel 1. ALSO RESERVING unto Southern California Gas Company, a Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove gas transmission pipelines in, under, and across said 60.00 foot -wide hereinabove described Parcel 1. ALSO RESERVING unto the City of Downey, a Municipal Corporation, an easement to construct, use, maintain, operate, and repair electrical conduit for street lighting, communication, and other purposes in, under, and across said 60.00 foot -wide hereinabove described Parcel 1. ALSO RESERVING unto the City of Downey an easement for surface drainage over said 60.00 foot -wide hereinabove described Parcel 1. Resolution NO. 4655 V -149 - Page 2 PARCEL 2 That portion of Second Street 60.00 feet wide as shown on the Map of said Tract of the Downey Land Association bounded on the east by the northwesterly line of Downey Avenue 84.00 feet wide and on the West by the northeasterly prolongation of the southeasterly line of hereinabove described Parcel 1. RESERVING unto the City of Downey, a Municipal Corporation, an easement to construct, use, maintain, operate, repair, replace or remove water line facilities, fire hydrants, sewers, manholes or other purposes in, under, over, and across said 60.00 foot -wide hereinabove described Parcel 2. ALSO RESERVING unto Pacific Bell Company, a Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove facilities for the transmission of electric energy for communication or other purposes in, under, over, and across said 60.00 foot -wide hereinabove described Parcel 2. ALSO RESERVING unto General Telephone Company of California, a Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove facilities for the transmission of electric energy for communication or other purposes in, under, over, and across said 60.00 foot -wide hereinabove described Parcel 2. ALSO RESERVING unto Southern California Edison Company, a Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove facilities for the transmission of electric energy, communications, and other purposes in, under, over, and across said 60.00 foot -wide hereinabove described Parcel 2. ALSO RESERVING unto Southern California Gas Company, a Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove facilities for transmission of gas or other purposes, in, under, or across said 60.00 foot -wide hereinabove described Parcel 2. ALSO RESERVING unto the City of Downey, a Municipal Corporation, an easement to construct, use, maintain, operate, repair, replace, or remove electrical conduit for street lighting, communications or other purposes in, under, and across said 60.00 foot -wide hereinabove described Parcel 2. SECTION 2. The hour of 7:30 p.m. on December 10, 1985, is hereby fixed as the time and the Council Chambers in City Hall at 11111 Brookshire Avenue, Downey, California, is fixed as the place for hearing all persons interested in the proposed vacation of said streets. SECTION 3. Notices of the proposed vacation shall be posted or published in the manner prescribed by Section 8322 of the Streets and Highway Code of the State of California. SECTION 4. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this 12th day of NavPmhPr , 1985.
