A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY, DENYING CONDITIONAL USE PERMIT NO. 213.
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find and determine
that an application was duly filed by Zenaida G. Bolado, with
respect to the real property described as follows: 9438
East Firestone Boulevard, requesting to remove an existing
retirement home and replace it with a new two -story retirement
facility in a C -2 Zone; that a public hearing was duly set
for August 13, 1985 at 7:30 p.m., in the Council Chamber of
the Downey City Hall, 11111 Brookshire Avenue, Downey, California,
and a notice of the date, time,place and purpose of aforesaid
hearing was duly given; that a hearing was duly held at the
aforementioned time and place. Studies and investigation made
by the Council and in its behalf reveal the following facts:
(1) That the requested Conditional Use Permit would not
be in harmony with existing and permitted land areas
surrounding the subject property and that it would not
consequently be consistent with the City General Plan,
the public convenience or general welfare of persons
working or residing in and around the subject project
and the neighborhood, since it would be promoting the
use of the property for residential care for both the
elderly and mentally disorder persons along a major
commercial highway corridor which is developed and is
planned for additional commercial uses.
(2) That this requested use would adversely affect
the adjoining land use and the growth and the redevelop-
- ment of the area in which this project is planned.
(3) That the size and shape of the property are not
adequate to accommodate the development as planned
since the interface of this use with the adjoining
commercial or potential commercial uses would not be
compatible.
(4) That the high volumes of traffic on Firestone
Boulevard will create difficulties for ingress and
egress to and from the subject site located along a
major highway.
SECTION 2. The City Council further finds and determines that
facts do not exist as required in Section 9166.12 of the Downey
Municipal Code justifying the granting of a Conditional Use
Permit.
SECTION 3. Based upon the aforementioned findings, the Council
hereby denies with respect to the property described in Section
1, above a Conditional Use Permit.
SECTION 4. The Secretary shall certify to the adoption of this
Resolution and shall transmit a copy to the Applicant, Building
and Safety Division, and City Engineering Division.
